AN ORDINANCE OF THE CITY OF NEWCASTLE, WASHINGTON, ADOPTING THE MUNICIPAL CODE, AS COMPILED, EDITED AND PUBLISHED BY CODE PUBLISHING COMPANY OF SEATTLE, WASHINGTON, AS THE OFFICIAL CODE OF THE CITY OF NEWCASTLE, WASHINGTON

WHEREAS, Code Publishing Company of Seattle, Washington, has contracted with Newcastle, Washington to prepare the Newcastle Municipal Code, as authorized by RCW 35.21.500 through 35.21.570 inclusive; and

WHEREAS, Code Publishing Company has compiled, edited and published the Newcastle Municipal Code on file in the office of the city clerk; and

WHEREAS, on March 16, 1998 the Newcastle City Council set a public hearing for April 6, 1998 regarding the adoption of the Newcastle Municipal Code and notice of the public hearing was published on March 25, 1998 in accordance with RCW 35.21.530; and

WHEREAS, the Newcastle City Council held a public hearing on April 6, 1998; and

WHEREAS, the Newcastle City Council has inspected the Newcastle Municipal Code and is satisfied that it is a correct and accurate codification of the ordinances of Newcastle, Washington; and

WHEREAS, the Newcastle City Council is satisfied that the provision of RCW 35.21.500 through 35.21.570 inclusive have in all ways been complied with, NOW THEREFORE,

THE CITY COUNCIL OF THE CITY OF NEWCASTLE, WASHINGTON, DO ORDAIN AS FOLLOWS:

Section 1. Code Adopted. The Newcastle Municipal Code, as compiled from the ordinances of the City of Newcastle, Washington, is hereby adopted as the official code of the City of Newcastle, Washington on file in the office of the city clerk.

Section 2. Title, Citation, Reference. The code shall be known as “The Newcastle Municipal Code” and it shall be sufficient to refer to said code as the “Newcastle Municipal Code” in any prosecution for the violation of any provision thereof or in any proceeding at law or equity. It shall also be sufficient to designate any ordinance adding to, amending, correcting or repealing all or any part or portion thereof as an addition to, amendment to, correction of, or repeal of the Newcastle Municipal Code. Further reference may be had to the titles, chapters, sections and subsections of the Newcastle Municipal Code and such reference shall apply to that numbered title, chapter, section or subsection as it appears in that code.

Section 3. Reference Applies to Amendments. Whenever a reference is made to the Newcastle Municipal Code or to any portion thereof, or to any ordinance of the City of Newcastle, Washington, that reference shall apply to all amendments, corrections and additions heretofore, now or hereafter made.

Section 4. Codification Authority. This code consists of all of the regulatory and penal ordinances and certain of the administrative ordinances codified pursuant to RCW 35.21.500 through RCW 35.21.570 inclusive.

Section 5. Effective Date. This ordinance shall take effect five days after its publication.
