Ordinance No. 4474
AN ORDINANCE relating to the Public Library and the Board of Library Trustees and their duties; repealing Sections 3.66.010, .020, .030, .040, and .050, and 3.67.050; and amending Sections 3.67.010, .020, .030 and .040 of the Bellevue City Code.
WHEREAS, Chapter 3.66 of the Bellevue City Code provides for creation of free library service for the City's inhabitants; and
WHEREAS, Chapter 3.67 of the code establishes a Board of Library Trustees and specifies their duties; and
WHEREAS, operation of the Library has been assumed by the King County Library System, which will support the Board of Library Trustees as an advisory body; now, therefore,
THE CITY COUNCIL OF THE CITY OF BELLEVUE, WASHINGTON, DOES ORDAIN AS FOLLOWS:
Section 1. Sections 2, 10, 11, 12 and 13 of Ordinance No. 88, Sections 2 and 3 of Ordinance No. 1759, and Section 2 of Ordinance No. 2115, and Sections 3.66.010, .020, .030, .040, and .050 of the Bellevue City Code are hereby repealed.
Section 2. The title of Chapter 3.67 of the Bellevue City Code is changed to "Library Advisory Board".
Section 3. Section 1 (part) of Ordinance No. 1759 and Bellevue City Code Section 3.67.010, as last amended by Section 8 of Ordinance 3727, are hereby amended to read as follows:
3.67.010 Terms - Expenses.
A. The Library Advisory Board shall consist of seven members, appointed by the mayor with the consent of the majority of the city council. Members shall serve without compensation for their service. Support for the board is to be provided by the King County Library District.
B. The terms for all positions on the board shall be four years and shall expire on May 31st of the last year of the term. Persons appointed to a position during the pendency of the term for that position shall serve until the end of the term. The expiration date of the terms of the positions on the board shall be staggered so not more than four positions expire in the same year.
C. No person may serve more than two consecutive terms, provided a person appointed to fill an unexpired term of less than two years is eligible to serve two successive four-year terms; and provided further, a person who is ineligible to serve for having served two terms may again serve after two years have elapsed from the end of the second such term.
Section 4. Section 1 (part) of Ordinance No. 1759 and Bellevue City Code Section 3.67.020, as last amended by Section 9 of Ordinance 3727, are hereby amended to read as follows:
3.67.020 Residence of members - Vacancies.
No person may be appointed to a position on the board unless he or she is a resident of the city. A position on the board becomes vacant when that member ceases to be a resident of the city. The position of a member is forfeited and becomes vacant for failure to attend three regular consecutive meetings of the board, unless such absence is excused by a majority of the members of the board.
Section 5. Section 1 (part) of Ordinance No. 1759 and Section 3.67.030 of the Bellevue City Code are hereby amended to read as follows:
3.67.030 Meetings - Organization.
The board of library trustees shall hold meetings at regular intervals as provided in bylaws adopted by the board. Members of the board shall select a chairperson from among themselves and such other officers as they may deem necessary and may establish rules for the conduct of the meetings and business of the board.
Section 6. Section 1 (part) of Ordinance NO. 1759 and Section 3.67.040 of the Bellevue City Code are amended to read as follows:
3.67.040 Responsibilities of the board.
A. The board shall make periodic reports and recommendations to the City Council and City Manager relative to the scope and quality of library services being provided by the King County Library District to the residents of the City and, to the extent it is requested to do so by the City Manager, shall represent the City's interests before the King County Library Board with respect to such services.
B. At the request of the King County Library District, the board shall make studies concerning the need for, acquisition, utilization, care, maintenance and disposition of the library building or buildings and all property or equipment pertaining to or associated with library purposes and review, advise and make recommendations to the King County Library Board relative to the promulgation and enforcement of rules and regulations governing the use of the library, its building(s) and equipment and rules of conduct and behavior of persons using the same and frequenting the library building(s).
Section 7. Section 1 (part) of Ordinance No. 1759 and Section 3.67.050 of the Bellevue City Code are hereby repealed.
Section 8. This ordinance shall be in full force and effect five days after its passage and legal publication.
