ORDINANCE NO. 3966

AN ORDINANCE CREATING A PUBLIC FACILITIES DISTRICT PURSUANT TO THE LAWS OF WASHINGTON, CHAPTER 165, LAWS OF 1999, CODIFIED AS CHAPTER 35.57 OF THE REVISED CODE OF WASHINGTON

WHEREAS, the City of Kennewick (the "City") is a municipal corporation operated as a non-charter code city, organized and existing under and by virtue of the laws of the State of Washington and located in a county with a population of less that one million; and

WHEREAS, pursuant to Laws of 1999, as codified as Chapter 35.57 of the Revised Code of Washington, a public facilities district may be created in any city, which district shall be co-extensive with the boundaries of the city, and shall be created by the legislative authority of the city in which the proposed district is located; and

WHEREAS, the City Council finds that it is in the public interest to create a public facilities district co-extensive with the boundaries of the City; NOW, THEREFORE,

THE CITY COUNCIL OF THE CITY OF KENNEWICK, WASHINGTON, DO ORDAIN AS FOLLOWS:

Section 1. Formation of Public Facilities District.

  1. Pursuant to Chapter 165, Laws of 1999 and RCW 35.57.010, there is hereby created a public facilities district to be known as the Kennewick Public Facilities District (the "District"). The District shall be co-extensive with the boundaries of the City of Kennewick and have all powers and authority as codified in RCW 35.57.
  2. Members of the District's Board of Directors shall be appointed from time to time pursuant to RCW 35.57.010(3)(a). The City shall appoint members to the Board of Directors by resolution. Members of the Board need not be residents of the City of Kennewick.

Section 2. Severability. If any section, subsection, sentence, clause, phrase or word of this Ordinance should be held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or unconstitutionality thereof shall not affect the validity or constitutionality of any other section, subsection, sentence, clause, phrase or word of this Ordinance.

Section 3. Effective Date. This ordinance shall be in full force and effect five days from and after its passage, approval and publication as required by law.
