Ordinance No. 1999-12-02
AN INTERIM ORDINANCE relating to land use and zoning confirming emergency ordinance 1997-12-33 and 1998-02-23 and 1998-12-07 and 1999-06-01, known as the single family home waiver to the Forest Practices mandatory moratorium.
WHEREAS, by Ordinance 1997-12-33 and 1998-02-23 and 1998-12-07 and 1999-06-01, the Board confirmed an emergency situation existed with respect to hardships resulting from a mandatory 6-year development moratorium placed on single-family building permits on land subject to a forest practice permit. This moratorium was required based on amendments to state law under SSB 5714. SSB 5714 authorizes local governments to adopt a waiver for building permits.
WHEREAS, the Board concluded that it is in the interest of the public health, safety and welfare to adopt emergency Ordinance 1997-12-33) and subsequent extensions to create and continue a provision to waive a six year state required building moratorium as imposed by SSB 5714 enacted during the 1997 legislative session.
WHEREAS, the Board held a daily advertised public hearing on December 15, 1998. to solicit public testimony on the emergency ordinance adopted December 17, 1997, and subsequently extended the ordinance again to December 17. 1998, with one minor change, the Board conducted another hearing on February 24, 1998, to extend the ordinance to June 17. 1999, and concluded it was in the best interests to reconfirm the amendments-, now therefore,
BE IT ORDERED AND RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF CLARK COUNTY, STATE OF WASHINGTON. as follows:- Section 1.
The Board reconfirms the adoption of Ordinance 1997-12-33) as amended by 1998-02-23), 1998- and 1999-06-01, as follows:
Emergency waiver provision.
During the effective period of this ordinance:The Planning Director, through a Type I procedure and without additional fee, shall waive the six (6) year moratorium solely for construction of one Single-family residence and related accessory buildings on a building Site Outside of Urban Growth Boundaries. Under the following conditions:
- The parcel is a legal lot of record;
- The building site area intended as developed property shall be no larger than 20% of the total lot, not to exceed 2 acres in size;
- The construction activity is consistent vvith Chapters 13.36 (Wetlands Protection), 13.51 (Shoreline Combining District) Including the Shoreline Management Master Program.
- The harvest was conducted under, and consistent with, all approved Forest
- A binding written commitment to complete the reforestation in accordance with applicable Forest Practice reforestation requirements has been subbmitted to the county.
Section 2. Ordinance 1997-12-33 with modifications in Section I as made in Ordinance 1998-02-23, 1998-12-07 and 1999-06-01, shall expire on June 16, 2000, unIess earlier superseded by a permanent ordinance.
Section 3. The work program contained in the Staff Report is adopted and attached as "Exhibit A".
Section 4. Instructions to Clerk. The Clerk to the Board shall:
(1) Transmit a copy of this ordinance to the Washington State Department of Community Trade and Economic Development within ten days ofits adoption Pursuant to RCW 36.70A. 106.
(2) Record a copy of this ordinance with the Clark County Auditor.
(3) Cause notice of adoption of this ordinance to be published forthwith pursuant to RCW 37.70A.290.
