The Washington Model Traffic Ordinance, Chapter 308-330 WAC, referred to as the “Model Traffic Ordinance (MTO),” including any future additions, amendments and repeals thereof, and all other statutes adopted by reference therein, is hereby adopted by this reference as if set forth in full herein, except as provided in WMC 10.03.020, and shall be known as the “Woodinville Traffic Ordinance.” (Ord. 93 § 1, 1994)

10.03.070 Penalty for violations of RCW 46.61.502 or 46.61.504.

10.03.080 Inattentive driving.
It is unlawful for any person to operate a motor vehicle within the City in an inattentive manner. For the purposes of this section, “inattentive manner” means the operation of a motor vehicle in a manner which evidences a lack of the degree of attentiveness required to safely operate the vehicle under the prevailing conditions, including but not limited to the nature and condition of the roadway, presence of other traffic, presence of other pedestrians, and weather conditions. The offense of operating a motor vehicle in an inattentive manner shall be considered an infraction, punishable by a fine of not more than $250.00, and a lesser offense than, but included in, the offense of operating a motor vehicle in a negligent manner. 10.03.090 Impoundment and redemption of certain vehicles.
Chapter 46.08 KCC, including any future additions to, and amendments and repeals thereof, is hereby adopted by reference. (Ord. 93 § 11, 1994)
10.03.100 Road restrictions.
The Traffic Engineer can declare an emergency and thus invoke road restrictions, deemed necessary by road and/or weather conditions, which would or would be likely to damage streets, roads, alleys, or highways, if emergency road limits, speed limits, and/or vehicle restrictions were not immediately placed upon such roadway, streets, alleys, or highways. (Ord. 93 § 15, 1994)
10.03.110 Parking.
The Traffic Engineer shall have full authority to adopt administrative orders enacting parking restrictions on City streets which are in the best interests of the City and the public health, safety and welfare. Any and all such parking restrictions are hereby adopted by this reference and made a part hereof as if set forth fully herein. No such administrative orders shall become effective until posted as provided by Chapter 2.31 WMC, Amendment of Administrative Rules.
On-street parking shall be prohibited at the following locations:
(1) NE 194th Street. Between the hours of 7:00 a.m. and 3:00 p.m., Monday through Friday, except holidays; on the north and south sides: from 131st Avenue NE to 164 feet east of 131st Avenue NE;
(2) NE 195th Street.
(a) On the north side: from 1,240 feet west of 136th Avenue NE to 136th Avenue NE;
(b) On the south side: from 641 feet west of 136th Avenue NE to 136th Avenue NE;
(c) Between the hours of 7:00 a.m. and 3:00 p.m., Monday through Friday, except holidays; on the south side: from 130th Place NE to 433 feet east of 131st Avenue NE;
(3) NE 196th Place. Between the hours of 7:00 a.m. and 3:00 p.m., Monday through Friday, except holidays; on the north and south sides: from 130th Place NE to 131st Place NE;
(4) NE 197th Place.

10.03.120 Avoidance of intersection.
It is unlawful for any person operating a motor vehicle on the highways of the City to turn such vehicle either to the right or to the left upon approaching or leaving intersections and to proceed across any private property for the purpose of avoiding the intersection or any traffic control device controlling the intersection, unless so directed by lawful authority. The offense of avoidance of an intersection shall be considered an infraction, punishable by a fine of not more than $250.00. (Ord. 93 § 18, 1994)
10.03.130 Driving or parking on private property prohibited.
No person shall drive, park or leave any vehicle upon the private property of another without his written consent and the owner and/or operator of any vehicle including two-wheeled vehicles, shall be found guilty of a misdemeanor in the event of violation of this section and inability to produce written verification thereof. This provision shall not apply to owners and/or operators of any vehicle who may utilize the driveway portion of another person’s property for convenience purposes such as turning said motor vehicle around. Where business premises provide off-street parking for its patrons or customers the owners or operator of said premises shall be deemed to have consented to the temporary parking of motor vehicles upon said premises in areas designated for said parking. 10.03.135 Parking adjacent to residential mailboxes restricted.
(1) It is unlawful to park directly adjacent to a curbside and within six feet of a clearly visible residential mailbox between the hours of 9:00 a.m. and 4:00 p.m. on any day scheduled for mail delivery by the United States Postal Service.
(2) Any violation of this section shall be an infraction punishable by a fine of not more than $50.00. (Ord. 388 § 1, 2005)
10.03.140 Overnight parking prohibited in residential areas.
(1) It is unlawful to park, or otherwise leave, overnight, between the hours of 12:01 a.m., and 6:00 a.m., on any street or highway in the City of Woodinville within or abutting an area classified as residential (R-1 through R-48 zoning codes) by the official zoning ordinance, the following types of trailers and/or vehicles:
(a) All types of trailers exceeding 80 inches in width designed to be drawn by a motor vehicle except recreation trailers;
(b) Buses and trucks used for business purposes in whole or in part, excluding pickup or panel trucks of less than one ton rated capacity.
(2) It is not necessary that restricted parking or other traffic signs be erected for the purpose of enforcing this section.
(3) Any violation of this section shall be an infraction with a fine of not more than $250.00. (Ord. 93 § 20, 1994)
10.03.150 Prohibition of trucks exceeding 26,000 pounds gross vehicle weight rated.

10.03.160 Penalties and procedure on arrest – General penalty.
Unless another penalty is expressly provided every person convicted of a violation of any section of this title shall be guilty of an infraction and punished by a fine of not more than $250.00. (Ord. 95 § 3, 1995; Ord. 93 § 22, 1994)
10.03.170 Disposition of traffic fines and forfeitures.
The City’s portion of any fines and forfeitures collected upon conviction or upon the forfeiture of any bail of any person charged with a violation of any provisions of this title shall be paid into the general fund of the City. (Ord. 95 § 3, 1995; Ord. 93 § 23, 1994)
10.03.180 Adoption includes amendments to the law.
Whenever a reference is made in this code to any statute or section of the Washington Administrative Code and the Revised Code of Washington, or any portion thereof, the reference shall apply to all amendments, corrections and additions heretofore, or hereafter made. 10.03.190 Copies of statutes adopted.
All State statutes comprising the Model Traffic Ordinance, Chapter 308-330 WAC, as adopted and modified by this chapter is adopted by this chapter, and all State statutes incorporated in the City’s traffic ordinance and by this chapter are attached to the ordinance codified in this chapter as Exhibit A and incorporated herein by this reference as if set forth in full. 10.03.200 Filing.
Incident to the adoption of the MTO by reference, by this chapter, one copy of the text of the adopted MTO and of other adopted statutes shall be filed as required by RCW 35A.12.140 for use and examination by the public. The City Clerk shall authenticate the statutes adopted by reference herein by signing the adopting ordinance and recording the adopting ordinance and statutes adopted by reference in full in the official ordinance book of the City of Woodinville. 10.06.010 State speed laws – Exceptions.
The State traffic laws regulating the speed of vehicles at 25 MPH shall be applicable upon all streets within the City, except that the legislative authority of the City, as authorized by State law, may declare and determine by order, rule or regulation, properly adopted, that certain increased or decreased speed regulations shall be applicable upon specified streets or in certain areas, in which event it is unlawful for any person to operate a vehicle at a speed in excess of the speed so established when proper signs are in place giving notice thereof. 10.06.020 Increasing State speed limit.
Whenever conditions are found to exist upon an arterial street or highway which warrant an increase in the speed permitted by State law, the legislative authority of this City, subject to the approval of the State Highway Commission in cases involving State highways, shall determine and declare a reasonable and safe maximum speed limit for such arterial street or highway, or portion thereof, not to exceed 55 miles per hour. 10.06.030 Decreasing State speed limit.
Whenever it is deemed inadvisable for vehicles to operate at the maximum speed allowed by State law at 25 MPH on any portion of a street or public highway on account of a sharp curvation, highway construction or repairs, excessive traffic, any dangerous condition, or other temporary or permanent cause, the legislative authority of the City, subject to the approval of the State Highway Commission in cases involving State highways, shall determine and fix a lower maximum speed or otherwise regulate a lesser speed; provided, that in no case shall the maximum speed be reduced to less than 20 miles per hour. 10.06.040 Schedule.
The maximum speed limits set forth in the following schedule of speed limits are hereby established at the reasonable and safe maximum speed limits to be effective at all times upon the streets and highways designated in the schedule.
The City Manager or the Manager’s designee shall cause appropriate signs to be erected on such streets and highways, giving notice of the speed limits, as provided in the previous section. (Ord. 21 § 4, 1993)
10.06.050 Speed limit 35 MPH.
A speed limit of 35 miles per hour is hereby established for motor vehicle traffic on the following streets, roadways, highways and no person shall operate a motor vehicle upon said streets, roads, or highways in excess of 35 miles per hour:
(1) NE Woodinville-Duvall Rd. between 350 feet north of NE 179th Street and the east City limits.
(2) 156th Ave. NE between NE Woodinville-Duvall Rd. and the north City limits.
(3) Woodinville-Snohomish Rd. between 140th Ave. NE and the north City limits.
(4) 130th Ave. NE, 130th Pl. NE, and 132nd Ave. NE between SR 522 and the north City limits.
(5) NE 171st Street, 146th Pl. NE, and NE 173rd Street between 140th Ave. NE and NE 172nd Street (150th Ave. NE).
(6) Woodinville Dr. between 127th Pl. NE and the west City limits.
(7) 124th Ave. NE between the south City limits and 730 feet north of NE 169th Street.

10.06.060 Speed limit 40 MPH.
A speed limit of 40 miles per hour is hereby established for motor vehicle traffic upon the following streets, roadways, and highways and no person shall operate a motor vehicle upon said streets, roads, or highways in excess of 40 miles per hour:
(1) NE 195th Street and NE North Woodinville Way between SR 522 and NE Woodinville-Duvall Rd.

10.06.070 Speed limit 45 MPH.
A speed limit of 45 miles per hour is hereby established for motor vehicle traffic upon the following streets, roadways, highways and no person shall operate a motor vehicle upon said streets, roads, or highways in excess of 45 miles per hour:
(1) Woodinville-Redmond Road (SR 202) between the south City limits (NE 143rd Street) and 525 feet south of 127th Pl. NE. (Ord. 95 § 1, 1995; Ord. 93 § 16(C), 1994)
10.06.080 Entry terminus.
The entry terminus of each street, roadway, or highway with a speed limit in excess of 25 miles per hour shall be posted with a sign clearly indicating the established legal speed limit. Advisory signs, indicating a reduced speed zone ahead, near the exit terminus of said street, roadway, or highway shall suffice as regulatory signs. Intersecting streets may be posted, where deemed advisable by the Traffic Engineer, with a sign indicating the legal speed limit on the intersecting streets, roadways, and highways. Intersections and curves may be posted with reduced speed limits where deemed advisable by the Traffic Engineer.
Except as provided above, no other signs or markings relating to speed shall be required on the affected streets, roadways, and highways, for the purposes of conformance and enforcement. (Ord. 95 § 1, 1995; Ord. 93 § 16(D), 1994)

Fire lanes in conformance with this code shall be established by the Building Official for the City, or his or her duly authorized representative, and in conjunction with the Fire Chief. These lanes shall be referred to as “Designated Fire Lanes” in this title. (Ord. 93 § 14, 1994)
10.12.020 Definition of fire lanes.
The area within any public right-of-way, easement or private property designated for fire trucks and other fire fighting or emergency equipment to use, travel upon and/or park. (Ord. 93 § 14(A), 1994)
10.12.030 Marking of fire lanes.
All designated fire lanes to be marked from this date forward, shall be clearly marked in one of the following manners:
(1) Vertical curbs six inches in height shall be painted yellow on the top and side, extending the length of the designated fire lane. The pavement adjacent to the painted curbs shall be marked with block lettering a minimum of 18 inches in height and with a three-inch brush stroke reading: “NO PARKING – FIRE LANE”. Lettering shall be yellow and spaced at no more than 50-foot intervals; or
(2) Rolled curbs or surface without curbs shall have a yellow six-inch wide stripe painted, extending the length of the designated fire lane. The surface adjacent to the strip shall be marked with block lettering a minimum of 18 inches in height and with a minimum three-inch brush stroke reading: “NO PARKING – FIRE LANE.” Lettering shall be in yellow and spaced at no more than 50-foot intervals; or
(3) Fire lane signs which shall be as follows:
(a) Reflective in nature;
(b) Use red letters on white background;
(c) Use three-inch lettering, to read “No Parking, Fire Lane”;
(d) A minimum of 12 inches wide by 18 inches tall;
(e) Spaced no more than 50 feet apart and posted on or immediately next to the curb or side of the road;
(f) Top of the sign to be not less than four feet nor more than six feet from the ground;
(g) Signs may be placed on a building when approved by the Building Official in coordination with the Fire Chief;
(h) When posts are required for signs, they shall be a minimum of two-inch galvanized steel or four-inch by four-inch pressure treated wood;
(i) Signs are to be placed so they face the direction of vehicular travel. (Ord. 93 § 14(B), 1994)
10.12.040 Obstruction of fire lanes prohibited.
The obstruction of a designated fire lane by a parked vehicle or any other object is prohibited and shall constitute a traffic and fire hazard as defined in State law and the Uniform Fire Code and be an immediate hazard to life and property. (Ord. 93 § 14(C), 1994)
10.12.050 Alternate materials and methods.
The Building Official, in coordination with the Fire Chief may modify any of the provisions herein, where practical difficulties may exist. The particulars of a modification shall be decided by the Building Official and shall be entered into the records of the Fire Department, local Police Agency and the Building Department. (1) Previously existing signs posted prior to this date, will be allowed to remain until there is a need for replacement. When replaced, the new sign must then meet the requirements as set forth in this chapter.
(2) Previously existing markings will be allowed to remain until there is a need for repainting. When repainted, the new markings must then meet the requirements as set forth in this chapter. (Ord. 93 § 14(E), 1994)
10.12.070 Maintenance.
Fire lane markings shall be maintained at the expense of the property owner(s) as often as is deemed necessary to clearly identify the designated area as a fire lane. (Ord. 93 § 14(F), 1994)
10.12.080 Towing notification.
Directly adjacent to where fire lanes have been designated, signs shall be posted as set forth in this chapter, in a clear, conspicuous location and shall clearly state “vehicles parked in fire lanes may be impounded.” They shall also state the name, telephone number and address of the towing company where the vehicle may be redeemed. There shall be at least one sign per designated zone. (Ord. 93 § 14(G), 1994)
10.12.090 Property owner responsibility.
The owner, manager, or person in charge of any property upon which designated fire lanes have been established, shall be responsible for, and not allow, vehicles or other objects to park in such fire lanes. (Ord. 93 § 14(H), 1994)
10.12.100 Violation – Infraction – Penalty.
Any person who fails to mark or maintain the marking of a designated fire lane as prescribed in this title, or who parks a vehicle in, allows the parking of a vehicle in, obstructs or allows the obstruction of a designated fire lane is guilty of an infraction. The maximum penalty for failing to mark or maintain the marking of a designated fire lane shall be not more than a fine of $350.00. The maximum penalty for parking a vehicle in, allowing the parking of a vehicle in, obstructing, or allowing the obstruction of a designated fire lane, shall be not more than a fine of $350.00. 10.12.110 Impoundment.
Any vehicle or object obstructing a designated fire lane is hereby declared a traffic and fire hazard and may be immediately impounded pursuant to the applicable State law, and Uniform Fire Code, without prior notification to its owner. Also, pursuant to State law, the owner may be held responsible for all impound fees. (Ord. 93 § 14(J), 1994)

10.16.010 Purpose.
The purpose of this chapter is to regulate and restrict by classification vehicular traffic upon certain City streets in order to prevent infrastructure damage, promote safe and efficient traffic flows, and preserve the integrity and safety of the City’s residential neighborhoods. 10.16.020 Definitions.
The terms used in this chapter shall have the following meanings unless otherwise specifically provided:
(1) “City” means the City of Woodinville.
(2) “Arterial” means that term as now or hereafter designated by the City’s arterial functional classification system.
(3) “Designated truck route” means those public roadways within the City limits that have been designated for usage by motor trucks and other heavy or large vehicles pursuant to this chapter.
(4) “Destination point” means the fixed location that the operator of a vehicle must directly access in order to load or unload goods, passengers or other cargo, or to perform services.
(5) “Parking” means that term as defined in RCW 46.04.381, as now or hereafter amended.
(6) “Hazardous cargo” means “hazardous materials,” as defined in RCW 70.136.020(1), as now or hereafter amended.
(7) “Residential area” means those areas of the City which constitute “residential districts” as defined in RCW 46.04.470, as now or hereafter amended.
(8) “Semitrailer” means that term as defined in RCW 46.04.530, as now or hereafter amended.
(9) “Trailer” means that term as defined in RCW 46.04.620, as now or hereafter amended.
(10) “Motor truck” means that term as defined in RCW 46.04.310, as now or hereafter amended.
(11) “Tractor” means that term as defined in RCW 46.04.650, as now or hereafter amended.
(12) “Truck tractor” means that term as defined in RCW 46.04.655, as now or hereafter amended.
(13) “Vehicle” means that term as defined in RCW 46.04.670, as now or hereafter amended. (Ord. 443 § 2, 2007)
10.16.030 Operation limited to designated truck routes.
Except as otherwise provided by this chapter, the operation of the following vehicles shall only occur upon and within (1) the designated truck routes established pursuant to this chapter, and (2) the State highway system within which such operation is unrestricted:
(1) Vehicles Restricted by Weight, Width and/or Length. Any motor truck, truck tractor, motor truck and trailer combination, or truck tractor and semitrailer combination, which exceeds eight feet in width, 26 feet in total length, or 26,000 pounds gross weight, including load.
(2) Vehicles Restricted by Cargo or Contents.
(a) Any vehicle transporting radioactive material; or
(b) Any vehicle transporting hazardous cargo. (Ord. 443 § 2, 2007)
10.16.040 Operation within residential areas prohibited.
Except as otherwise provided by this chapter, it is unlawful to operate any vehicle listed in WMC 10.16.030 within any residential area of the City. (Ord. 443 § 2, 2007)
10.16.050 Designated truck routes.
Except as otherwise provided by this chapter, the operation within the City limits of any vehicle listed in WMC 10.16.030 shall be restricted to the confines of (1) the State highway system, and (2) the following designated truck routes:
Route 1. Woodinville-Snohomish Road between 140th Avenue and north City limit.
Route 2. 140th Avenue NE between south City limits and Woodinville-Snohomish Road.
Route 3. NE 195th Street/NE North Woodinville Way between NE Woodinville-Duvall Road and SR 522.
Route 4. Woodinville-Duvall Road between the east City limits and NE Woodinville-Duvall Road.
Route 5. NE 190th Street between NE North Woodinville Way and Woodinville-Snohomish Road.
Route 6. NE Woodinville-Duvall Road between NE North Woodinville Way and 140th Avenue NE.
Route 7. Little Bear Creek Parkway between NE 190th Street and SR 202.
Route 8. SR 202 between SR 522 and south City limit.
Route 9. NE 171st Street/131st Avenue NE between 140th Avenue NE and NE 175th Street.
Route 10. Woodinville Drive (aka Brickyard Road) between SR 202 and westerly City limit.
Route 11. 124th Avenue NE between south City limit to NE 160th Street. (Ord. 443 § 2, 2007)
10.16.060 Truck route map.
A map of the City’s designated truck routes is attached to the ordinance codified in this chapter as Exhibit A and is hereby incorporated herein by this reference as if set forth in full. (Ord. 443 § 2, 2007)
10.16.070 Exceptions.
The prohibitions set forth in this chapter shall not apply to the following:
(1) The operation of a vehicle upon any street where directly and unavoidably necessary in order to access or depart from a destination point. When a destination point is not located immediately adjacent to a State highway route or a designated truck route, the vehicle operator shall access and/or depart from the destination point using the shortest and most direct City arterial route to and from the nearest State highway route or designated truck route.
(2) The operation of emergency and law enforcement vehicles.
(3) The operation of any vehicle owned or operated by the City, a public utility or any contractor or materialman, while directly engaged in the repair, maintenance or construction of streets, street improvements, or street utilities within the City.
(4) The operation of any vehicle within and pursuant to any officially established temporary detour route.
(5) The operation of any vehicle directly engaged in the disposal, collection and/or transport of waste, including but not limited to recyclable material, as a part of a regularly scheduled curbside or on-site disposal or collection service within the Woodinville City limits; provided, that this exception shall not apply to hazardous cargo or radioactive materials.
(6) The operation of passenger buses, including but not limited to mass transit vehicles and school buses.
(7) The operation of vehicles directly engaged in transporting perishable commodities or commodities necessary for the health and welfare of local residents. (Ord. 454 § 2, 2008; Ord. 443 § 2, 2007)
10.16.080 Enforcement – Penalty.
Any person violating any provision of this chapter shall be found to have committed a traffic infraction and shall be subject to monetary penalties pursuant to the penalty schedule set forth in Chapter 46.44 RCW and Section 6.2 of Infraction Rules for Courts of Limited Jurisdiction, including any future amendments thereto. In addition to any penalty for violating the provisions of this chapter, violators shall also be liable in a civil action instituted in the name of the City for any damage caused to City streets, infrastructure or other public property resulting from such violation.
