Notification of apparent successful
proposer -- Prenegotiation activities authorized. (1) Upon the
commission's selection of a proposal under WAC 468-600-355 and
upon expiration of the protest period, the department shall
notify the proposer of its intent to execute a contract or
development agreement or to enter negotiations on a contract
and/or development agreement.
(2) Upon the commission's provisional selection of a
proposal subject to satisfaction of conditions, and upon
expiration of the protest period, the department shall notify
the proposer of the conditions. The proposer shall have a
period of time, set forth in the department's notice, but to
be at least ten calendar days, from receipt of the
department's notification to elect to proceed under specified
conditions. If the proposer elects to proceed, the department
shall work with the proposer to develop a plan for satisfying
the conditions. If the plan entails entry into an interim
agreement, the agreement will conform to all relevant
requirements of chapter 47.29 RCW and these rules.
(3) After the commission's selection or provisional
selection of a proposal, the department and the proposer may
confer on any matter pertinent to refinement of the proposal.
