WAC 365-197-080
An agency may deny a project based upon
consistency analysis. (1) An agency has the authority to deny a
project if it:
(a) Is inconsistent and does not comply with the applicable
development regulations, or in their absence, the adopted
comprehensive plan;
(b) Will result in significant adverse environmental impacts
which cannot be mitigated per RCW 43.21C.060 and WAC 197-11-660;
or
(c) Does not comply with other local, state, or federal law
and rules, and the local jurisdiction has the authority to deny
based upon these other laws and rules.
(2) This rule is not intended to modify any criteria
developed by a GMA county/city for denying a project.
