De novo review. What does a presiding
officer consider? The presiding officer will conduct a de
novo review of the department's action(s) in reaching its
initial order. New facts and law may be presented to the
presiding officer to support or contest a department action in
the course of an adjudicative proceeding, except to the extent
that new facts or argument are limited by other laws and
rules.
