The requirements in WAC 296-62-07355 through 296-62-07386 apply only to agriculture. The requirements for all
other industries relating to ethylene oxide have been moved to chapter 296-855 WAC, Ethylene oxide.
(1) WAC 296-62-07355 through 296-62-07389 applies to all
occupational exposures to ethylene oxide (EtO), Chemical
Abstracts Service Registry No. 75-21-8, except as provided in
subsection (2) of this section.
(2) WAC 296-62-07355 through 296-62-07389 does not apply
to the processing, use, or handling of products containing EtO
where objective data are reasonably relied upon that
demonstrate that the product is not capable of releasing EtO
in airborne concentrations at or above the action level, and
may not reasonably be foreseen to release EtO in excess of the
excursion limit, under the expected conditions of processing,
use, or handling that will cause the greatest possible
release.
(3) Where products containing EtO are exempted under
subsection (2) of this section, the employer shall maintain
records of the objective data supporting that exemption and
the basis for the employer's reliance on the data, as provided
in WAC 296-62-07375(1).
