Delegation of authority. Upon the
request of a local health jurisdiction, the department may
delegate authority to implement and assist in the
administration of appropriate portions of this chapter.
Delegation must be consistent with any applicable
state-EPA agreement regarding delegation of federal biosolids
program authority.
(1) Method of delegation.
(a) Delegation will be accomplished through an instrument
of mutual consent that is acceptable to both the department
and the local health jurisdiction seeking delegation.
(b) The department may revoke part or all of a delegation
of authority under this section if it finds that a local
health jurisdiction has failed to adequately carry out any
portion of a delegated responsibility.
(2) Contents of delegation agreements.
(a) At a minimum, delegation agreements must specify the
authorities and responsibilities that are being delegated to a
local health jurisdiction.
(b) Other authorities and responsibilities are assumed to
be retained by the department.
(c) All delegation agreements must have a termination
date that is no more than five years from the date signed.
