Employment -- Certain criminal
history--Permitted. (1) Nothing in this section may be
interpreted to require the employment of any person against
the judgment of the provider or entity representative.
(2) The adult family home may choose to employ a person
if the person has one or more convictions for a past offense
and the offense was:
(a) Simple assault, assault in the fourth degree and
three or more years has passed between the most recent
conviction and the date of the application for employment;
(b) Prostitution and three or more years has passed
between the most recent conviction and the date of the
application for employment;
(c) Theft in the third degree and three or more years has
passed between the most recent conviction and the date of the
application for employment;
(d) Theft in the second degree and five or more years has
passed between the most recent conviction and the date of the
application for employment; or
(e) Forgery and five or more years has passed between the
most recent conviction and the date of the application for
employment.
