Conditions for granting a certificate. (1) If the application is in proper form and sets forth facts
showing:
(a) A subminimum wage is necessary to prevent curtailment
of the handicapped worker's opportunities for employment;
(b) The handicap impairs the earning capacity of the
worker for the work he is to perform, a certificate may be
issued.
(2) The director or his authorized representative may
require the submission of additional information to that shown
on the application and may require the handicapped worker to
take a medical examination where it is deemed necessary in
order to determine whether or not the issuance of a
certificate is justified.
