Use of brief adjudicative proceedings
(BAPs). (1) Presiding officers must use brief adjudicative
proceedings (BAPs) for:
(a) Stays of summary suspension; and
(b) Denying or revoking extended operating hours for:
(i) Card games; and
(ii) Bingo; and
(c) Charitable or nonprofit licensee appealing a denial
of a request for waiver of significant progress requirements;
and
(d) Failure to pay required gambling taxes, where that is
the only alleged violation in the administrative charges; and
(e) When the penalty we are requesting is a suspension of
seven days or less; and
(f) When the parties stipulate to using a BAP.
(2) If we conduct a BAP, we may conduct them
telephonically and, therefore, the notice of hearing will not
set a place of the hearing.
(3) Any party to the BAP may request to appear in person
and, in those cases, a place will be set and all parties
notified.
