1.01.010 Adoption of Code.
A. There is adopted the Spokane Municipal Code, consisting of sixteen numbered titles, as revised through December 11, 2000.
B. There is included within the printed code the Charter of the City of Spokane as amended by the general election of November 7, 2000.
1.01.020 Effect of Code.
The supplemented code identified in SMC 1.01.010(A) is intended to be an official statement of the general ordinances of the City of Spokane as of December 31, 1996.
1.01.030 Citation of Code.
A. The provisions herein adopted constitute the Spokane Municipal Code and any reference to the code, a title, chapter, division, article, section, or other subdivision, as such, is a sufficient citation for all purposes.
B. The Spokane Municipal Code may be abbreviated and cited as “SMC.”
C. Unless qualified by reference to a point in time or to a particular ordinance, any reference to this code includes the provision referenced and all amendments and additions thereto.
1.01.040 Amendment of Code.
A. The city council interprets the last sentence of Charter section 21 as prescribing a method of amendment and not as prescribing a minimum unit of text which may be amended. Charter section 21 provides that this code may not be amended by that parliamentary method known as insert and/or strikeout; rather, amendment is by setting forth the entire text of the provision as amended. For example, the addition of two words to SMC 1.01.030(B) may not be accomplished in the form: “That SMC 1.01.030(B) be amended by inserting the words ‘may be’ before the word ‘cited.’” Rather, that addition is to be in the form: “That SMC 1.01.030(B) be amended to read as follows: B. The Spokane Municipal Code may be abbreviated and may be cited as ‘SMC.’”
B. Any logical unit of text may be amended, whether it be designated a section, subsection, paragraph, or other subdivision.
C. As may be provided by council rules of procedure, this section does not prevent the council from adopting a motion that an existing or proposed ordinance be amended by inserting and/or striking out words or paragraphs, but such amendment is not effective until embodied in a filed ordinance setting forth in final form the provision as amended.
D. As a matter of policy when clarity will be aided, the City follows the amendatory format of the Washington State Code Reviser, whereby:
1. Language (including punctuation) to be deleted is set forth in full and enclosed in double parentheses or brackets (and may be lined out by hyphens or italicized);
2. New matter to be added is underlined, unless an entire new section, subsection, or other unit is being added; and
3. Deletions precede additions.
E. The city clerk has the authority to correct clerical or typographical errors and to make technical or editorial changes, such as recodifying or renumbering (including relettering) provisions, in this code as necessary.
1.01.050 Captions – Headings.
Chapter headings, section captions, and similar catchlines are included in this code for the convenience of the reader and are not part of the code or a title in any manner as would limit or restrict the scope or operation of the language of any provision.
1.01.060 Invalidation of Code.
Should this code or any provision of this code be held invalid as a codification, then those ordinances from which the invalidated provision derives or upon which it is based shall remain in full force and effect as if this code had not been adopted.
1.01.070 Publication of Code.
The Spokane Municipal Code shall be published pursuant to the following schedule and standards:
A. The Spokane Municipal Code shall be republished on a calendar quarterly basis at the end of each calendar quarter.
B. Each republication of the code shall include publication on the city’s website at the time of each republication.
C. Publication on the city’s website shall include a search engine at the site of each republished code that is for the context of the code.
D. Copies of each republication of the code shall be made available for download on the city’s website. The city will also provide a text-based format on CD to any database provider upon request, free of charge.
