15.02.010 In General.
Whereas, pursuant to the Clean Air Act (42 USC 1857, et seq.), the Environmental Protection Agency, the Federal Highway Administration, the Urban Mass Transportation Administration, the State of Washington Departments of Ecology and Transportation, the Spokane transit authority, Spokane County and the City of Spokane are variously engaged in a number of cooperative air pollution control measures in the metropolitan area, those measures which have been adopted by ordinance are collected or referenced in this chapter to signify that they have been ordained through joint governmental action or because mandated by superior law. The amendment or repeal of the provisions in this chapter are not matters wholly within the legislative discretion of the city council.

15.02.020 “Idling” Defined.
“Idling” means the running of an engine which supplies the motive power for a vehicle, when not for the purpose of moving the vehicle with the normal flow of traffic on a street or roadway. Idling does not include running the vehicle’s engine while stopped at a traffic signal or waiting for the passage of other vehicles to permit safe entry into the flow of traffic.

15.02.030 Central Business District Portion of Nonattainment Area – Carbon Monoxide.
The CBD portion of the nonattainment area for carbon monoxide is that area designated by the following boundaries: Spokane River on the north, east side of Division Street on the east, I-90 freeway on the south, and the west side of Madison on the west.

15.02.040 Excessive Idling Prohibited.
A. Excessive Idling in the Central Business District Portion of the Nonattainment Area Prohibited. Unless permitted by subsection (B) of this section it is unlawful for the operator of any vehicle powered by an internal combustion engine while located in the CBD portion of the non-attainment area to cause said engine to idle for a period longer than sixty seconds.
B. Idling Permitted. To the extent necessary for the specified purpose, idling is permitted in the following cases:
1. police, sheriff or other law enforcement vehicles, including meter patrols, as required for safe and effective performance;
2. fire department vehicles, ambulances and other emergency vehicles when responding to an emergency or when the use of special equipment requires that the engines remain in operation;
3. construction or demolition equipment or other machinery when actually employed at the site of such work, and only to the extent necessary for efficient operation;
4. trucks, buses, or automobiles equipped with lift gates, winches, or other devices powered by take-offs from their engines, to the extent necessary to allow use of those devices provided; provided, however, that this subsection does not authorize idling solely for the purpose of operating any heating device, radio, power-assisted brakes, steering, seat adjustment or any luxury device not then required for safe operation of the vehicle;
5. vehicles participating in parades if licensed under SMC chapter 10.39;
6. buses or other mass transit vehicles while operated on a regular schedule;
7. insofar as necessary for diagnosis, adjustment, or testing, vehicles undergoing repair or maintenance; but only when on the premises of the owner or person performing the work;
8. any vehicle when required in an emergency for the protection of life, health, or property.
C. Notices. The street director shall cause to be placed such notices as he may deem necessary to inform drivers of the prohibition against excessive vehicle idling; however, actual knowledge of the prohibition is not an element of an offense under this chapter.

15.02.050 No-Parking Zones.
These special zones are established on the following streets, as described, and shall be so posted:
A. Peak Hour Prohibition. No parking between seven a.m. to nine a.m. and four p.m. to six p.m., Monday through Friday:
Monroe Street:
West side, from Riverside Avenue to Third Avenue;
East side, from Sprague Avenue to First Avenue; from 554.9 feet south of the south curb line of First Avenue to the alley south of Second Avenue;
Lincoln Street:
West side, from 516.9 feet north of the north curb line of Second Avenue to 245.6 feet north of the north curb line of Riverside Avenue;
East side, from 118.8 feet north of the north curb line of Third Avenue to Riverside Avenue; from 73.4 feet north of the north curb line of Riverside Avenue to Main Avenue;
Wall Street:
West side, from Main Avenue to Spokane Falls Boulevard;
Stevens Street:
West side, from Spokane Falls Boulevard to Main Avenue; from 64.8 feet south of the south curb line of Riverside Avenue to two hundred fifty-four feet south of the south curb line of Fourth Avenue; from Fifth Avenue to two hundred thirty-nine feet south of the south curb line of Fifth Avenue; from Sixth Avenue to Seventh Avenue;
East side, from Spokane Falls Boulevard to 84 feet south of the south curb line of Sprague Avenue; from 65.7 feet south of the south curb line of First Avenue to 129.9 feet south of the south curb line of First Avenue; from five hundred eleven feet south of the south curb line of First Avenue to Third Avenue; from forty-seven feet south of the south curb line of Third Avenue to two hundred thirty-eight feet south of the south curb line of Third Avenue; from Fourth Avenue to two hundred fifty-four feet south of the south curb line of Fourth Avenue; from Fifth Avenue to Seventh Avenue;
Washington Street:
West side, from one hundred fourteen feet north of the north curb line of Sixth Avenue to Fourth Avenue; from one hundred eighteen feet north of the north curb line of Fourth Avenue to 53.8 feet north of the north curb line of First Avenue; from Sprague Avenue to ninety-nine feet north of the north curb line of Riverside Avenue; from the alley north of Riverside Avenue to Spokane Falls Boulevard;
East side, from Sixth Avenue to Fourth Avenue; from seventy-five feet north of the north curb line of Fourth Avenue to ninety-five feet north of the north curb line of Second Avenue; from Pacific Avenue to two hundred forty-five feet north of the north curb line of Main Avenue.
B. No Parking Bus Zone.
No parking except STA buses:
Howard Street:
Both sides, from First Avenue to Main Avenue.
C. No Parking Any Time.
No parking any time:
Monroe Street:
East side, from sixty-five feet south of the south curb line of First Avenue to 534.2 feet south of the south curb line of First Avenue; from fifty-five feet south of south curb line of Third Avenue to alley south of Third Avenue;
Lincoln Street:
West side, from 154.1 feet north of the north curb line of Second Avenue to 516.9 feet north of the north curb line of Second Avenue;
Wall Street:
East side, from 207.4 feet north of the north curb line of Riverside Avenue to 59.9 feet north thereof;
Stevens Street:
East side, from 127.9 feet south of the south curb line of First Avenue to 511.0 feet south of the south curb line of First Avenue;
Washington Street:
East side, from Sixth Avenue to one hundred eighty-four feet north of the north curb line of Sixth Avenue.
D. Commercial Loading Zones.
1. Within the following described limits, commercial loading zones shall have effective hours of nine a.m. to four p.m.:
Monroe Street:
West side, from Riverside Avenue to Third Avenue;
East side, from Sprague Avenue to Third Avenue;
Lincoln Street:
West side, from Second Avenue to Main Avenue;
East side, from Third Avenue to Main Avenue;
Wall Street:
West side, from Main Avenue to Spokane Falls Boulevard;
Stevens Street:
Both sides, from Spokane Falls Boulevard to Seventh Avenue;
Washington Street:
Both sides, from Seventh Avenue to Spokane Falls Boulevard;
Howard Street:
Both sides, from First Avenue to Main Avenue.
2. Within the following described limits, commercial loading zones shall have effective hours of six a.m. to six p.m.:
Riverside Avenue:
Both sides, from Lincoln Street to Stevens Street.
3. Within the following designated limits commercial loading zones shall have effective hours of nine a.m. to three-thirty p.m.:
Monroe Street:
East side, from 554.9 feet south of the south curb line of First Avenue to 581.9 feet south of the south curb line of First Avenue;
Stevens Street:
East side, from 108.5 feet south of the south curb line of First Avenue to 129.9 feet south of the south curb line of First Avenue.

15.02.060 Tow-away Zones.
The zones described in SMC 15.02.050 shall be clearly marked as “tow-away zones.” Stopping, standing, or parking when prohibited in such a zone subjects the vehicle to immediate removal by any police officer under SMC 16.55.113.

15.02.070 Solid Waste Trucks Exempt.
None of the provisions of this chapter shall be applicable to City of Spokane solid waste management department trucks engaged in garbage and refuse collection activities.
