12.05.010 Vacant Property – Gardens.
A. The city council finds the City owns certain unused vacant property which would not be harmed and would be benefited if put to use by volunteers, without cost, for private gardens.
B. The city engineer or his designee is authorized to issue permits to private citizens authorizing them to enter designated areas of vacant municipal property, to remove debris and litter therefrom and to plant gardens thereon.

12.05.020 Permit Revocable – Waiver – Hold Harmless.
A. The permits are mere licenses and may be revoked with or without cause at any time the city engineer or his designee determines.
B. Permittees on their own behalf and the behalf of their heirs and assigns, as a condition of the permit, waive all claims for bodily injury or property damage against the City, its agents and employees. Permittees accept the areas designated “as is.”
C. Permittees on their own behalf and the behalf of their heirs and assigns, as a further condition of the permit, covenant to fully indemnify the City, its agents and employees, against all loss or liability occasioned by use or enjoyment of the permit.
D. Permits are nonassignable.
