Article I. Coliseum Smoking
12.04.0100 Application – Coliseum.
The city council finds the Spokane Coliseum at N. 1101 Howard Street in Spokane, Washington, to be a unique building requiring specific exercise of the police power of the City in the interest of the public health and safety. This article applies only to that building.
12.04.0102 No Smoking – Exceptions.
A. No smoking of any kind is permitted in the Spokane Coliseum. No person shall carry a lighted match, lighter, pipe, cigarette, cigar, or any other ignited device or use any spark, flame, or fire-producing device in the Spokane Coliseum.
B. This article shall not apply to corridors, restrooms, or side rooms outside the main auditorium area in the Spokane Coliseum building. It shall not apply to performers in the context of any show or public exhibition.
C. The entertainment facilities director grants exceptions to this article where he determines there are adequate precautions to protect the public health and safety to allow smoking in the main auditorium of the Spokane Coliseum. He may impose conditions upon the granting of an exception.

12.04.0104 Encouraging Smoking.
No person shall encourage or facilitate violations of this article.
12.04.0106 Placards.
Placards or signs shall be conspicuously displayed in the Coliseum where directed by the entertainment facilities director to properly advise the public of the prohibition against smoking.

Article II. Concessions
12.04.020 Concessionaires – Right of Entry.
A. The city council finds and declares that the protection of the public health and safety require professional management and discretion in the operation of the City’s public assembly facilities and that their use and enjoyment be reserved for public patrons of events approved and licensed concessionaires and licensed presenters of events therein. Said facilities are the Spokane Opera House, Convention Center, Joe Albi Stadium and the Spokane Coliseum.
B. No person, without permission of the Spokane Riverpark center director, shall enter upon any of the City public assembly facilities premises or buildings for any commercial purpose. As used herein, the facilities premises includes parking lots and surrounding areas of buildings up to the public right-of-way.
12.04.030 Pirating Prohibited.
No person shall sell or distribute on or near any City public assembly facility, as described in SMC 12.04.020, any materials, including free samples, flyers, placards, T-shirts, novelties, or other miscellaneous items in violation of copyright or duly licensed concession rights of others. Possession of a general peddler’s license from the City or other entity shall not excuse compliance with this section.
12.04.040 Penalty.
The penalty for violation of this chapter is up to fifty dollars and/or ten days in jail per violation.
