Article I. Felts Field
12.03.0100 Felts Field.
Except as otherwise specifically provided, this article applies only to Felts Field Spokane City-County Airport.

12.03.0102 Compliance with FAA, CAB Airport Rules.
No person shall navigate any aircraft, land aircraft upon, or fly from or on the airport otherwise than in conformity with the current Federal Aviation Agency and Civil Aeronautics Board Rules and Regulations.
12.03.0104 User’s Obligation.
The use of the airport, or any of its facilities, in any manner, shall create an obligation on the part of the user thereof to obey the rules and regulations herein prescribed and the rules and regulations adopted by the Spokane airport board.

12.03.0106 User’s Risk.
All aircraft operators, pilots, or other persons shall use the airport at their own risk. The airport owner will not be responsible in case of the failure of lights or any other equipment used by the airport for safety purposes or any other purpose.

12.03.0108 Signs – Advertisement – Permission.
No person shall post, distribute, or display signs, advertisements, circulars, or printed or written material at Felts Field Airport, Spokane, Washington, except with the approval of and in such manner as may be prescribed by the Spokane airport board.

12.03.0110 Traffic Rules.
No person shall travel on Felts Field Airport other than on the roads, walks, or places provided for the particular class of traffic. No person shall use the roads or walks in such a manner as to hinder or obstruct their proper use.

12.03.0112 Disabled Aircraft – Notice.
It shall be the responsibility of the aircraft owner, pilot in charge, authorized agents, or representatives to immediately notify the airport manager of any disabled aircraft on the airport in order that arrangements can be made for the removal of such aircraft and parts thereof to a designated area unless delay for such action is necessary from an official investigation standpoint.

12.03.0114 Aircraft Parking.
A. Aircraft shall not be parked in any other area than that designated by the airport manager.
B. Aircraft shall not be parked at the passenger terminal building except for the purpose of loading or unloading passengers or cargo.
C. All repairs to engines or aircraft, except emergency repairs shall be accomplished in spaces designated for this purpose.

12.03.0116 Motor Vehicle Parking.
A. Motor vehicles shall not be moved or driven upon runways, taxiways, aircraft aprons, or airside areas designated by the airport director without permission of the airport director. Those motor vehicles moved or driven upon these areas shall display a flashing yellow light of a design approved by the airport director.
B. No person may park a motor vehicle on the airport property except in areas designated for that purpose and in accordance with all restrictions and regulations as may be imposed by the airport board or airport director. Vehicles parked in undesignated areas, or in violation of other posted restrictions, or otherwise in violation of the traffic code are subject to removal and impoundment by the airport management and to the other enforcement provisions of article VI of this chapter.

12.03.0118 Starting, Warming and/or Running of Aircraft Engines.
A. Aircraft engines shall be started and warmed only in places designated for such purpose.
B. No aircraft engine shall be operated unless a licensed pilot or mechanic is at the controls.
C. Any aircraft not equipped with locking brakes shall have the wheels adequately blocked before starting any engines.
D. No aircraft engine shall be started without adequate fire extinguishers being available to personnel to extinguish any fire as a result of starting operations.
E. No aircraft engines shall be operated in any hangar.
F. No aircraft engine shall be run up immediately in front of or adjacent to the passenger terminal building, or with the aircraft in such a position that parked aircraft taxiways, runways, or spectators are in the path of the propeller slipstream.

12.03.0120 Taxiing – Taxi Pattern Charts.
A. Preceding takeoffs and after landings aircraft shall be taxied in conformity with established taxi pattern charts.
B. No person shall taxi an aircraft to or from the hangar line or to or from an approved parking space until he has ascertained that there will be no dangers of collision with other aircraft, persons, or objects in the immediate area.
C. Aircraft shall taxi at speeds that will insure complete control at all times, and at no time in excess of fifteen miles per hour.
D. While awaiting takeoff clearance, aircraft shall not be taxied past the holding lines painted on the taxiways.
E. The center taxi strip is to be used as an exit taxiway only.
F. Aircraft shall not be taxied into or out of any hangar.

12.03.0124 Takeoff, Flight Pattern and Landing – Traffic Pattern Charts.
A. All takeoffs and landings shall be made on the runway most nearly aligned with the tetrahedron located on the north side of the field.
B. The tetrahedron on the north side of the airport is the only authorized air traffic direction indicator to be used.
C. Traffic patterns affecting all runways are standard left-hand rectangular patterns and are flown within two miles of the airport.
D. Aircraft may leave the traffic pattern by climbing straight out after takeoff until the aircraft has passed beyond the established traffic pattern.
E. Simulated forced landings shall not be made over or on the airport.
F. Landing aircraft shall taxi straight ahead to the nearest taxiway and shall clear the runway as soon as possible. One hundred and eighty degree turns will not be permitted on the runway.

12.03.0130 Fire Regulations.
A. All persons using in any way the airport area or the facilities of the airport shall exercise the utmost care to guard against fire and injury to persons or property.
B. No person shall smoke within fifty feet of any aircraft.
C. No aircraft shall be fueled while the engine is running.
D. All aircraft shall be positively grounded when being serviced with gasoline.

12.03.0132 Penalties.
In addition to penalties otherwise provided, any person operating or handling any aircraft in violation of these rules, or refusing to comply herewith, may be promptly removed or ejected from the airport by or under the authority of the airport manager and, upon the order of the airport manager, may be deprived of the further use of the airport and its facilities for such a length of time as may be required to insure the safeguarding of the same and the public and its interest therein.

12.03.0134 Damage – Responsibility.
Any person damaging, injuring, or destroying airport property, either by accident or otherwise, shall be liable for the reasonable value of the property so damaged or destroyed.

12.03.0136 Accident Reports.
Witnesses and participants in accidents on or within the airport shall make a full report thereof to the airport manager as soon as possible.

12.03.0138 Manager’s Authority – Suspension – Special Events.
A. The airport manager or his authorized representative may suspend or restrict any or all aircraft operations on the airport whenever such action is deemed necessary in the interest of safety.
B. Special events or demonstrations are not permitted on the airport without the written permission of the airport manager.

Article II. Litter – Spokane International Airport
12.03.0300 Application.
This article applies to Spokane International Airport.
12.03.0302 Litter Unlawful.
No person shall dispose of any paper, trash, can, bottle, garbage, waste, or other refuse material within the boundaries of Spokane International Airport except in receptacles provided for such purpose.

12.03.0304 Penalty.
Any person who violates the provisions of this article shall be deemed guilty of a misdemeanor and upon conviction thereof shall be punished by a fine not exceeding two hundred fifty dollars or by imprisonment in the county or city jail for a term not exceeding ninety days, or by both such fine and imprisonment.

Article III. Solicitation Activities
12.03.0400 Findings.
The enacting legislative bodies find:
A. RCW chapter 14.08 et seq. and the joint agreement of the City and County of Spokane signed June 9, 1986, by the City and September 16, 1986, by the County, provide for the adoption of rules and regulations governing the conduct of persons and people at Spokane International Airport; and
B. It is necessary to adopt the following rules and regulations to insure the orderly flow of traffic and people in and through the terminal building of said Spokane International Airport; and
C. The terminal building at Spokane International Airport is overcrowded by reason of its configuration and rapidly accelerating number of passengers; and
D. The City and County of Spokane desire to provide for the constitutional right of freedom of expression without impairing or substantially interfering with the security or operational functions of said airport or substantially interfering with the orderly flow of passengers or tenants within the terminal building.

12.03.0402 General Restrictions.
A. No person, group of persons, association, organization, or business entity shall engage in any solicitation of funds, goods, or services for any purpose whether charitable, nonprofit, commercial, or otherwise; nor shall any person, group of persons, organization, association, or business entity distribute literature, picket, display signs, or conduct similar organized systematic communicative activities at Spokane International Airport without a permit issued by the airport’s director in accordance with the rules herein set forth or without a license or lease for a commercial enterprise to be conducted at Spokane International Airport. A commercial enterprise is any person, group of persons, association, organization, or business entity who engages in any profit-making activity whether involving an exchange of property, rights, services, or otherwise, and does not currently qualify for exemption from taxation under section 501(c) of the Internal Revenue Code of 1954.
B. No person, group of persons, organization, association, or business entity, whether present at the airport pursuant to a permit, license, or lease required by subsection (A) of this section or otherwise shall obstruct, impair, or interfere with the use of the airport premises by persons or vehicles passing therethrough. Obstruction, impairment and interference with the use of the airport as used herein is limited to prevention of access by others to facilities, amenities, or public areas of the airport; prevention of normal and customary operations and activities at the airport; physically blocking ingress to or egress from the terminal or any public area at the airport; or causing substantial delay in the flow of pedestrian or vehicular traffic; but in no event shall ordinary attempts to engage in communication or social intercourse constitute obstruction, impairment, or interference with the use of the airport premises.
C. Any applicant for a permit required by subsection (A) of this section shall, as a precondition of the issuance of a permit, sign an indemnification and hold harmless agreement which shall undertake to indemnify the Spokane airport board, the City, the County of Spokane, their elected and appointed officers, agents and employees, against any claim that might be made against any of the foregoing by reason of activities conducted by the permittee or its agents at Spokane International Airport, unless said claim is proximately caused by the negligence of Spokane International Airport or its agents.

12.03.0404 Procedures for Permits.
A. Any person, group of persons, organization, association, or business entity which desires to obtain a permit required by SMC 12.03.0402(A) shall submit an application therefor to the airport’s director. The application for a permit shall include the following information:
1. the name and address together with the telephone number, if any, of the person, group of persons, organization, association, or business entity which is sponsoring, promoting, or organizing the activity if in fact any such sponsor, promoter, or organizer exists; and
2. a short description of the nature of the activity which the applicant wishes to conduct and its purpose; and
3. the location, date, time and duration of the activity which the applicant wishes to conduct and the number of people that are expected will participate in it; and
4. the names, ages and current addresses of each individual who will participate in the activity which the applicant wishes to conduct; and
5. a copy of any literature which the applicant intends to display or distribute and the text of any signs or other visual displays which the applicants intend to utilize; and
6. a statement that the applicant has read the resolution and ordinance codified in this chapter and has agreed to abide thereby.
B. A permit required by SMC 12.03.0402(A) shall be issued by the airport’s director within five calendar days of receipt of the completed application therefor, or the applicant shall be furnished a written statement setting forth the reason why the application for a permit has been denied. A statement of reasons for denial of a permit shall be served on an applicant personally or by certified mail, return receipt requested. If a statement of reasons for denial of a permit has not been served or mailed within five days of the date of receipt by the airport’s director of the application, then an interim permit shall be deemed issued to the applicant under this chapter by operation of law, and all activities proposed to be conducted in the application for the permit may be conducted as though a permit has been duly issued by the airport’s director, subject to the same restrictions and obligations under this chapter as other permittees.

12.03.0406 Denial.
A. An application shall be denied for no other reason than any one of the following:
1. The applicant has not furnished the information required by SMC 12.03.0404(A), or has failed to comply with SMC 12.03.0402(C);
2. There has been within the previous twelve months a final and binding judicial determination as provided herein by subsection (B) of this section that the applicant has violated this chapter which has resulted in the revocation of a previous permit as provided in SMC 12.03.0410(A);
3. The applicant constitutes a commercial enterprise as defined in SMC 12.03.0402(A) and is subject to other licensing or leasing requirements at Spokane International Airport;
4. Emergency conditions exist at Spokane International Airport which make the applicant’s proposed activity at the time and location proposed by the applicant absolutely incompatible with the operational function of the airport; or
5. More applicants than herein provided have proposed permitted activities for the same time and locations and the applicant is not entitled to priority under the standards described in SMC 12.03.0434.
B. In the event that any permit is denied, the airport’s director shall within five days following such denial, apply to either the United States District Court for the Eastern District of Washington or to the superior court of Spokane County, Washington, for a judicial determination as to whether the proposed activity described in the application is properly prohibited, naming the applicant as a party defendant. The airport’s director shall exert every reasonable effort to have this issue heard on its merits without delay and as soon as is legally possible. The burden of showing that the proposed solicitation may be prohibited shall rest on the airport’s director.
C. If the issue for judicial determination described in subsection (B) of this section is not heard and determined by the court within fifteen calendar days from the date the complaint is filed, then an interim permit shall be deemed issued under this chapter to the applicant by operation of law, and all activities proposed to be conducted in the application for the permit may be conducted just as though a permit had been duly issued by the airport’s director, subject to the same restrictions and obligations under this chapter as other permittees.
D. The interim permit shall be deemed renewed each weekly period for so long as no judicial determination has been made. All parties shall be bound by the trial court’s determination pending appeal.

12.03.0408 Appeal.
A. Upon notification of the denial of a permit required by SMC 12.03.0402(A), or revocation thereof, an applicant may, but is not required to, file with the office of the airport’s director a notice of appeal to the Spokane airport board. Upon receipt of a notice of appeal, the airport’s director shall suspend efforts to obtain a judicial determination of the validity of the denial or moratorium of the permit as required by SMC 12.03.0406(B), until the notice of appeal is withdrawn or until the denial or revocation of the permit is determined by the Spokane airport board.
B. Upon receipt of the notice of appeal, the airport’s director shall set the matter for a hearing before the Spokane airport board within ten days thereof and shall issue a notice of hearing which shall be sent by certified mail, return receipt requested, to the applicant and which shall contain the time and place of the hearing.
C. At the hearing the applicant may be represented by counsel. Testimony shall be taken upon oath or affirmation first of witnesses in support of the denial of the permit. The applicant may testify and present witnesses on his behalf. A court reporter record shall be made of the proceeding. A record shall be kept of all evidence received or considered in addition to the oral testimony.
D. The findings and order of the Spokane airport board shall, within five calendar days of the conclusion of the hearing, be forthwith sent to the applicant by certified mail, return receipt requested. If the denial of the permit is upheld by the Spokane airport board or if the notice of appeal is withdrawn prior to a final determination of the issue by the Spokane airport board, the airport’s director shall undertake to obtain a judicial determination of the validity of the denial of the permit as required by SMC 12.03.0406(B).

12.03.0410 Revocation.
A permit required by SMC 12.03.0402(A) shall be revoked by the airport’s director when evidence exists that a permittee has violated any of the sections of this chapter or has violated SMC 12.03.0432. Notice of revocation shall be in writing supported by a statement of facts and a list of witnesses to the facts stated, and the notice shall be personally served upon the permittee or mailed to the permittee by certified mail, return receipt requested. Upon service of a notice of revocation, the airport’s director shall undertake to obtain a judicial determination of the validity of the revocation in the same manner and within the same periods as are required by SMC 12.03.0406 when applications for permits are denied.

12.03.0412 Term – Renewal.
A. A permit required by SMC 12.03.0402(A) shall be effective for a period of seven days after being issued and shall be automatically renewed by filing with the airport’s director, prior to the expiration of the permit, a notice that the permittee intends to continue his activity together with any amendments necessary to keep the information required by SMC 12.03.0404(A) current and accurate.
B. A permit shall not be renewed if the notice and information herein required are not timely filed or if the continued presence of the permittee cannot be accommodated under the apportionment of space required by SMC 12.03.0434.

12.03.0414 Areas of Permit Exercise.
A. In order to not unduly interfere with the orderly flow of the general public, the activities herein referred to shall be carried out only on the sidewalk on the north side of the terminal building or within the rotunda portion of the terminal building outlined in red on Exhibit A, attached to the original adopting city ordinance and county resolution on file with the airport director.
B. In order to avoid the blocking of traffic, if more than one permittee is present, they shall not conduct their activities on the sidewalk, closer to each other than fifteen feet and shall not conduct such activities within five feet from any entrance or exit door to or from the terminal building.
C. If permittees cannot agree upon the area of their activities on the sidewalk, the airport’s director shall determine the matter, giving preference to the permittee having the earliest permit.

12.03.0416 Signs – Limits.
A permittee shall not display or carry any signs within the terminal building and shall not display or carry signs in the designated sidewalk areas that are larger than four square feet. No sign shall be attached to any portion of the premises at Spokane International Airport. All signs shall be removed when permittees are not present. No permittee shall carry more than one sign.

12.03.0418 No Loud Noise.
No person shall use any sound or voice amplification system, musical instruments, radio communication equipment or system, or other mechanical sound devices while conducting permitted activities. No singing, dancing, or loud talking which could interfere with public address announcements shall be permitted.

12.03.0420 No Obstruction – Delay.
No person, while engaging in permitted activities, shall physically obstruct or substantially delay the free movement of pedestrian and automobile traffic within the boundaries of Spokane International Airport, nor shall such permitted activity prevent, interfere with, hamper, or curtail the conduct of business affairs at Spokane International Airport as defined in SMC 12.03.0402(B).

12.03.0422 Consent of Public.
The Spokane airport board, the airport’s director, their agents and employees, shall not unnecessarily interfere with any consensual conversation between permittees and members of the general public. Permittees shall forthwith terminate any conversation with any member of the general public when requested to do so by the addressee.

12.03.0424 Literature.
Permittees may offer literature to the general public but shall refrain from attempting to distribute literature to any member of the general public who indicates he or she does not desire to receive said literature.

12.03.0426 Identification.
Each person engaged in activities covered by this chapter shall wear, on the outside of his/her clothing, an identification badge or label giving the individual’s name and the name of the group or organization which he or she represents. The printing on said badge shall be in the English language and of sufficient size to enable the general public to read the same.

12.03.0428 No Misrepresentations.
No permittee, while engaging in solicitation of funds, shall misrepresent the true purposes for which the resources thus obtained will be utilized by the individual or by the group or organization which he represents. In the solicitation of funds, the permittee shall inform the person being solicited of the true name of the organization for which said funds are solicited. No false, fraudulent, or misleading statements or representations shall be made.

12.03.0430 No Touching.
No permittee, while engaged in permitted activities, shall physically touch or contact a member of the general public unless the person has previously consented to the contact or unless the person has previously agreed to contribute to the permittee or the organization which he represents.

12.03.0432 Compliance with Laws.
Permittees will obey all state, federal and municipal criminal and civil laws applicable to them including, but not limited to, laws respecting battery, fraud, and extortion.

12.03.0434 Limit on Numbers.
A. No more than five persons may conduct permitted activities at any one time on the sidewalk and no more than two persons may conduct permitted activities at any one time within the designated area in the rotunda of the terminal building.
B. If more than one person, group of persons, organization, association, or business entity applies for a permit for a given time and location, the airport’s director shall allocate the number of persons permitted to conduct activities proportionally among the applicants so that the total number of permittees shall not exceed seven.
C. If an exact apportionment cannot be made, the airport’s director shall give preference to the applicant or applicants who have had the least opportunity during the preceding thirty calendar days to conduct permitted activities.
D. If there are more than seven applicants for a permit at a given time, the airport’s director shall give preference to the applicant or applicants who have had the least opportunity to conduct permitted activity during the preceding thirty calendar days.
E. If there are more than seven applicants for a permit at a given time, and no basis exists for granting preference among them according to prior opportunity to conduct permitted activities, the applicants shall be given preference in the order in which their applications were filed.
F. The provisions of this section shall likewise apply to the determination of the location of permitted activities if any conflict exists between the locations sought by applicants.

12.03.0436 Accidents – Report.
Any permittee involved in an accident at the Spokane International Airport which results in injury to persons or damage to property shall forthwith report the occurrence to the airport’s director, or, in his absence, to a security officer.

12.03.0438 Invalidity.
In the event that any portion of the foregoing regulations are declared invalid for any reason, the remainder of these regulations shall not thereby be invalidated but shall remain in full force and effect, all parts being declared separable and independent of all others.

12.03.0440 Purpose.
The resolution and ordinance codified in this article is adopted for the express purpose of accommodating freedom of expression and the operational functions of Spokane International Airport and shall be construed and interpreted to achieve that end. In particular, any construction or interpretation which would make this chapter vague in its application, overbroad, or which would require the exercise of uncontrolled discretion by the airport’s director shall be rejected.

12.03.0442 Assistant Director.
In the absence of the airport’s director, an assistant airport’s director shall act in his stead in all matters covered by this chapter.

12.03.0444 Misdemeanor.
Violation of any section, or part thereof, of this chapter shall constitute a misdemeanor.

Article IV. Airport Access – Commercial Activity – Motor Vehicles
12.03.0500 Findings.
The enacting legislative bodies find:
A. Because of the special nature of the Spokane International Airport and Felts Field and the necessity to provide for the free flow of traffic to and from the airport and provide for the orderly flow of ground transportation and regulating other activities on the airport, special rules and regulations are necessary for the orderly operation of the airport and its surrounding facilities.
B. The use of the airport, or any of its facilities, in any manner, shall create an obligation on the part of the user to obey the rules and regulations herein prescribed.

12.03.0502 Application.
This article applies to Spokane International Airport and Felts Field Airport, jointly referenced as “airport.”

12.03.0504 Access Restricted.
No person shall enter any restricted area posted as being closed to the public except:
A. persons assigned to duty therein;
B. persons authorized by the airport manager;
C. passengers under appropriate supervision entering the apron area for the purpose of enplaning or deplaning.

12.03.0506 Authorization – Commercial Activity.
No person shall engage in any business or commercial activity or in the sale of any commodity or service on the airport unless specifically authorized by lease or concession agreement with the Spokane airport board, or unless permission is first granted by the airport manager.

12.03.0508 For-Hire Vehicles.
No person shall operate any vehicle for hire from the airport unless such operation is with the approval of the Spokane airport board and under such terms and conditions as the airport board shall prescribe.

12.03.0510 Travel on Roads.
No person shall travel on the airport other than on the roads, walks, or places provided for the particular class of traffic. No person shall use the roads or walks in such manner as to hinder or obstruct their proper use.

12.03.0512 Motor Vehicles.
Motor vehicle operation within the airport shall be governed generally by the provisions of the Washington State Motor Vehicle Code and, in addition, shall conform to the special regulations prescribed herein.

12.03.0514 Speed Limits.
No person shall operate any motor vehicle on the roads and streets within the airport in excess of twenty-five miles per hour, except that the maximum speed on the access road from P.S.H. No. 2 to the service road intersection at Spokane International airport shall be fifty miles per hour and the maximum speed on the road adjacent to and surrounding the public parking lot at the Spokane International Airport shall be twenty miles per hour. The airport manager shall cause appropriate signs to be posted and maintained on the roadways indicating such maximum lawful speeds.

12.03.0516 Vehicles Prohibited.
No person shall operate any motorized vehicle or equipment on the aprons, the aircraft landing area, or taxiways except:
A. persons assigned to duty thereon;
B. persons authorized by the airport manager.

12.03.0518 Violations.
A violation of any provision of this article is a misdemeanor punishable as provided in SMC 1.02.950 except any violation which is declared to be a traffic infraction by RCW title 46 or SMC title 16.

12.03.0520 Severability.
In the event any section of this chapter is declared invalid by a court of competent jurisdiction, such adjudication shall in no manner affect the other sections of this chapter.

Article V. Impoundment of Motor Vehicles
12.03.0600 Findings.
A. The enacting legislative bodies find:
1. By previous joint resolutions both entities authorized the Spokane airport board to promulgate rules and regulations governing the parking and impounding of motor vehicles at Spokane International Airport and Felts Field; and
2. Pursuant to SMC 12.03.0650 and County Resolution 81-0876, the administration and enforcement of airport parking rules was contracted to the City of Spokane and its parking violations department; and
3. By Ordinance No. C28936, passed November 23, 1987, the City amended its traffic code to adopt Washington State procedures for the administration and enforcement of parking provisions through the Spokane municipal department of the Spokane County district court; and
4. Reserved;
5. While the streets and roadways within the airport are not public highways and have not been dedicated as such, those roads giving access to and circulation in and about the terminal and parking facilities are, in fact and in function, public ways and subject to the application of the local police power as it pertains to motor vehicle traffic and parking; and
6. It is necessary that rules and regulations be adopted to provide for the orderly flow of traffic to and from the airport, the deplaning and enplaning of passengers, the delivery of goods and services to the airport and the protection of the public health, safety and welfare of the users of the airport and its facilities; and
7. It is necessary for the uniform application of the parking laws within Spokane County and for the orderly and efficient operation of its district court that parking violations occurring on airport property be processed and disposed of the same as all other parking infractions; and
8. It is the intent of the City and the County of Spokane to authorize the Spokane airport board to adopt RCW title 46 and SMC title 16 to govern the parking and impounding of motor vehicles consistent with the laws of the State of Washington, as if the public access roads within the airports were public highways.

12.03.0602 Application of Traffic Code.
This article and by reference the applicable provisions of RCW title 46 and SMC title 16 apply to Spokane International Airport and Felts Field Airport, hereafter “airport” except that:
A. The airport board and airport director exercise the authority of the city council, mayor and street director with respect to designating and signing no-parking, metered parking and other special parking and loading areas; and
B. A notice of infraction may be issued by any regular or specially commissioned law enforcement officer, including airport security personnel.

12.03.0612 Impoundment of Vehicles – Towing Service.
Whenever an airport security officer finds a vehicle stopped, parked, left standing, or unattended in violation of this joint ordinance, or any of the rules and regulations promulgated by the Spokane airport board where the board has declared the same to constitute an immediate hazard or potential hazard to the public safety, or where a vehicle is found unattended in such a position that it constitutes an obstruction of traffic, or so as to endanger any user or potential user of the public streets or ways open to the public on the Spokane International Airport, or jeopardize the public safety, then said officer is authorized to remove and tow away the vehicle, or to have the same removed and towed away by a commercial towing service authorized by the Spokane airport board and called on a rotating basis.

12.03.0614 Towing Services – List – Storage.
A. Towing services may be deleted from the list for failure promptly to remove vehicles when called and/or comply with other reasonable equipment and trained personnel requirements.
B. Vehicles so removed may be placed in a commercial storage garage or in the public parking lot of the airport and may be restored to the owner upon satisfactory proof of ownership and payment of appropriate towing and storage charges as determined by the Spokane airport board. Said tow truck operators will be required to accept major credit cards or checks, if the holder has a major credit card for identification.

12.03.0648 Penalties.
The penalties for each violation of the provisions of this article are as provided in SMC 8.02.083.

12.03.0650 Contract for Administration and Enforcement.
A. The Spokane airport board is authorized to contract with either the City or the County of Spokane for the administration and enforcement of this article upon terms and conditions as may be determined by the Spokane airport board and the entity of government selected by the Spokane airport board.
B. Any present or future administrative procedures and enforcement remedies applicable to the entity of government selected by the Spokane airport board to administer and enforce this chapter shall also apply to violation of this article.

12.03.0652 Ordinances Superseded.
Previously adopted joint ordinances regulating parking and impounding of motor vehicles at Spokane International Airport are superseded so far as they are inconsistent with this joint ordinance: County Ordinance No. 65-170, adopted April 27, 1965, and City Ordinance No. C18020, adopted May 3, 1965; County Ordinance No. 66-139, adopted April 4, 1966, and City Ordinance No. C18448, adopted April 11, 1966; and County Ordinance No. 66-492, adopted August 25, 1966, and City Ordinance No. C18661, adopted September 6, 1966.

12.03.700 Plans Approved.
The Spokane International Airport Industrial Park Master Plan dated December 1978, and the Spokane International Airport Industrial Park Short Range Development Plan dated November 1982, are approved.

12.03.900 Saving.
Unless specifically provided otherwise in a particular ordinance, an amendment (or addition or repeal) of a provision of this chapter does not affect the rights and responsibilities of any person, or the City or the County or the airport board, under prior law or relieve a person from any liability, civil or criminal, arising from violation of such prior law. A proceeding pending at the time an amendatory or repealing ordinance takes effect continues according to the law in effect at the time the proceeding began.
