10.38.010 License Required.
No person may place within the public right-of-way any unattended rack, box, or other mechanical dispensing device for the sale or other dissemination of a newspaper, magazine, or other document without a current class III license issued by the director of engineering services.

10.38.020 Application.
An applicant for a license to place a mechanical dispenser must submit:
A. a plan of each or of a typical device showing dimensions, materials, mode of anchorage, lettering and other identification, and such additional details as the director may prescribe;
B. the fee for each proposed location;
C. a detailed location plan for each device;
D. a certificate of general liability insurance on the occurrence form, with bodily injury and property damage limits of at least one hundred thousand dollars per person, three hundred thousand dollars per occurrence and one hundred thousand dollars for property damage or three hundred thousand dollars combined single-limit coverage, naming the City of Spokane an additional insured, providing coverage against claims by users of the public ways arising from the presence of such devices;
E. written consent from the owner of any pole, post, or other structure to be used in securing a device.

10.38.030 Limitations on Location.
The director does not issue a license for a location which:
A. would be the fourth location on one side of the street in any one block;
B. does not employ a suitable metal pole or standard, unless in a residential area where there are no metal standards;
C. would interfere with traffic, particularly at crosswalks, bus stops, or other special parking areas; or
D. is within ten feet of a fire hydrant.

10.38.040 Dispenser Specifications.
Allowable dispensers:
A. consist of a metal frame, a metal back panel, metal legs fastened to the back of the frame and other panels made of either metal or clear plastic;
B. have a main dispenser box which does not exceed twenty-five inches in width, twenty inches in height and ten inches in depth;
C. have a total height above grade of between twenty-six and forty-five inches;
D. have no legs, signs, or other parts which protrude beyond the maximum box width;
E. have no lettering beyond that giving the name of the publication dispensed or the owner of the device;
F. are of a color reasonably conforming to that of the standard to which secured; and
G. in the downtown area are attached to the street light poles or other suitable metal standards by chain and padlock.

10.38.050 Revocation of License.
Licenses under this chapter are issued for one year but may be sooner revoked if:
A. The licensee fails to maintain the device in a safe condition and in compliance with the requirements of this chapter;
B. The security accorded by the licensee’s general liability insurance becomes impaired; or
C. Circumstances render any particular location inappropriate because of changed traffic patterns or other reasons of public safety or convenience.
