6.06.010 General Authority.

A.  The Spokane public library, although an agency of the City of Spokane, is a separate statutory entity under RCW chapter 27.12 and other laws for certain purposes. As provided by state law, the board of trustees of the Spokane public library is the governing body of the municipal library system. The board employs a librarian who is responsible for all aspects of library administration and operation, is employed by the Spokane public library, and answers to the library board of trustees.

B.  Wherever this code or another ordinance or policy vests authority in the “mayor,” such authority is exercised by the “librarian” or “library director” with respect to library matters. Wherever in this code or other ordinances or policies the term “city council” is used, such term refers to “library board of trustees” with respect to library matters.

C.  While the City performs budgeting, accounting and payroll services for the library, the budget of the library fund is fixed by the library board and expended exclusively for library purposes as determined by the library board.

D.  Nothing in this code precludes the library board from adopting appropriate policies for personnel, procurement, contracts, or other library matters, consistent with the authority granted in RCW chapter 27.12 and other applicable laws.

6.06.020 Procurement.

The library may utilize the City’s purchasing resources but nothing in this code or in the rules and regulations governing procurement will limit the authority of the library to adopt and implement its own policies and procedures for procuring, borrowing, loaning and renting of library materials, including books, magazines, newspapers, periodicals, pictures, records, tapes and other informational or educational materials and media.

6.06.030 Employees.

The City performs payroll and benefits services with respect to library employees, who are members of the employees’ retirement system, but employees of the Spokane public library are not City employees for civil service or collective bargaining purposes.
