4.06.010 Construction Review Board – Purpose.
The construction review board (hereinafter referred to as “the board”) is created for the purpose of hearing appeals from the hearings officer and to advise the City and County building officials on such matters as they may bring before the board.

4.06.020 Construction Review Board – Members.
A. The construction review board has six members consisting of two registered design professionals (architect or engineer) and four representatives of the construction industry. The City building official and the County building official shall act as ex-officio nonvoting members.
B. The members shall elect a chairman annually. The chairman will be a nonvoting member, except in the event of a tie.

4.06.030 Construction Review Board – Appointment.
The mayor of the city shall nominate and the city council shall appoint and the board of county commissioners shall each appoint one registered design professional and two representatives of the construction industry as members of the board. All appointments shall be made from residents of Spokane County who are qualified by training and experience with expertise in building codes. Members are appointed to staggered three-year terms. No person shall serve two consecutive terms but may be reappointed after a three-year period. Vacancies are filled by appointment for the remainder of the term. Members who are appointed to a term which has less than two years remaining may be reappointed for another full term.

4.06.035 Construction Review Board – Initial Appointments.
The board of county commissioners shall appoint their initial members for the following terms: design professional, three years; first industry representative, two years; second industry representative, one year. The city council shall appoint their initial members for the following terms: first industry representative, three years; second industry representative, two years; design professional, one year.

4.06.040 Construction Review Board – Meetings.
The board shall hold meetings at the request of either the City or County building official. Upon receipt of any appeal, the board shall hold a meeting giving notice as set forth herein. Board members and appellants shall be notified of the meeting date seven days in advance. The board shall not meet more than twice monthly. A quorum is four. All hearings before the board shall be informal. The board shall enter written findings of fact and decision. All meetings shall be held in accordance with the Open Meetings Act, RCW chapter 42.30.

4.06.050 Construction Review Board – Decisions Final.
Decisions of the board are final and conclusive unless within ten days from the date of the signing of the findings concerning decisions, the appellant or a party having standing makes application to a court of competent jurisdiction for a writ of certiorari.

4.06.060 Construction Review Board – Rules and Regulations.
The board is authorized and directed to adopt rules and regulations for the conduct of its business.

4.06.110 Board of Boiler Examiners – Created.
There is created the board of boiler examiners and appeals to:
A. examine and determine the qualification and fitness of applicants for, and accordingly issue or deny, the various classes of boiler operator’s licenses, as provided in SMC 10.29.020;
B. hear appeals from licensing decisions of the boiler inspector;
C. make rules and regulations and provide municipal boiler and pressure vessel code interpretations; and
D. hear appeals from boiler and pressure vessel owners having to do with code enforcement and approval for special or non-ASME code vessel installations.

4.06.120 Board of Boiler Examiners – Members.
A. The board consists of the boiler inspector and three citizens, at least one of whom must hold a first class boiler operators license, appointed by the building official subject to the approval of the mayor.
B. Members are appointed to staggered three-year terms.
C. The board elects a chairman.

4.06.130 Board of Boiler Examiners – Meetings.
A. The board meets at the call of the boiler inspector.
B. Two appointed members constitute a quorum. The boiler inspector serves as clerk.
C. In case of appeal from a licensing decision of the boiler inspector, the boiler inspector does not vote.
D. Each appointed member is entitled to compensation in the sum of forty dollars for each meeting attended.

4.06.140 Board of Boiler Examiners – Decisions Final.
A. Decisions of the board on licensing matters are final.
B. Decisions of the board on boiler and pressure vessel code matters are final or may be referred to the State of Washington Board of Boiler Rules.

4.06.150 Board of Heating Mechanical Examiners – Created.
There is created the board of heating mechanical examiners to:
A. determine the character of, and conduct the examinations of, applicants for the various heating mechanic and oil burner installer licenses, as provided in SMC 10.29.030;
B. hear appeals from licensing decisions of the mechanical inspector; and
C. make rules and regulations.

4.06.160 Board of Heating Mechanical Examiners – Members.
A. The board consists of the mechanical inspector and three citizens appointed by the director of building subject to confirmation by the building commission. The appointment members consist of:
1. the holder of a Heating Mechanic II license,
2. an employee of a gas utility,
3. a representative of the mechanical contractors.
B. Members are appointed to staggered three-year terms.
C. The board elects its chairman.

4.06.170 Board of Heating Mechanical Examiners – Meetings.
A. The board meets at the call of the mechanical inspector.
B. Two appointed members constitute a quorum. The mechanical inspector serves as secretary.
C. In case of appeal from a licensing decision of the mechanical inspector, the mechanical inspector does not vote.
D. Each appointed member is entitled to a fee of forty dollars for each examination conducted.

4.06.180 Board of Heating Mechanical Examiners – Decisions Final.
