4.05.070 “Art” Defined.

4.05.010 Purpose.

In recognition of the facts that artists and artistic institutions of Spokane contribute to and provide cultural, educational, entertainment and recreational benefits available to and used by the citizens of Spokane and enhance the public environment and welfare, the Spokane arts commission is established to promote and encourage public programs to further the development of public awareness of and interest in the fine and performing arts and preservation of the cultural heritage of the city in connection with the artistic and cultural development of the city.

4.05.020 Appointment.

The commission consists of sixteen members nominated by the mayor and appointed by the council to staggered three-year terms. Vacancies are filled by appointments to unexpired terms in the same manner.

4.05.030 Officers.

The commission by rule determines its officers and the manner of their selection, except that the mayor nominates and the city council appoints the chair of the commission for a term of one year.

4.05.040 Duties and Functions.

The commission has the power and duty:

A.  to adopt rules;

B.  to hold regular public meetings and keep a written record of its proceedings which is a public record;

C.  to initiate, sponsor, or conduct, alone or in cooperation with other public or private agencies, public programs to further the development and public awareness of, and interest in, the fine and performing arts, and preservation of the cultural heritage of the city;

D.  to encourage donations and grants to the City for civic arts purposes, to advise the City regarding the receipt of such donations and grants and transmit any funds so received to the City;

E.  to advise the City concerning the receipt of or purchase of works of art to be placed on municipal property;

F.  to advise and assist the City in connection with such other artistic and heritage activities as may be referred to it by the City.

4.05.050 Municipal Arts Plan.

A.  The commission, with the approval of the city council, prepares and amends from time to time a Municipal Arts Plan to guide selection, procurement, placement, maintenance and management of tangible art works on City property.

B.  The Municipal Arts Plan will provide, without limitation, for such matters as:

1.   the methods of selecting artists and art works;

2.   the placement and related design considerations of art works in City facilities;

3.   meeting any extraordinary operational and maintenance expenses a work of art may require; and

4.   procedures for commission review of art proposals.

4.05.060 Commission Review of Proposals.

A.  The commission reviews and makes recommendations to the council regarding:

1.   the implementation of municipal art projects, as provided in SMC 7.06.400;

2.   every proposal to procure or place tangible art work on City property;

3.   the interior and exterior of City structures;

4.   the removal, relocation, or alteration of existing municipal art work.

B.  The commission may upon request provide comment upon the arts activities of the park board, the sports, entertainment, arts and convention advisory board and the library board.

4.05.070 “Art” Defined.

A.  For the purposes of SMC 4.05.040(E), 4.05.050 and 7.06.400, “art” means visual art, including sculpture, painting, weaving, photography, print-making, drawing, calligraphy and the fine crafts.

B.  For the general purposes of the commission, such as provided in SMC 4.05.040(C), (D) and (F), “art” includes not only visual art but also literary and performing arts, such as dramatic, comedic and musical theater, dance, music, poetry and other creative writing.
