10.12.010 Purpose.
The purpose of this chapter is to restrict vehicles by weight, height or length from using County roads. (Ord. 3-1995)
10.12.020 Oversize vehicles prohibited.
The movement of any oversize vehicle on County roads shall be unlawful when the vehicle has an outside width, height, overall length or weight in violation of Chapter 46.44 RCW, as the same now exists or may hereafter be amended. (Ord. 3-1995)
10.12.030 Permit required.
The operator of a vehicle which exceeds the height, width, length or weight restrictions set forth in SJCC 10.12.010 may apply to the County engineer or his deputy for a permit authorizing the operation of the vehicle for one trip or for one round trip by providing the engineer or his deputy, prior to the operation of the vehicle, the route the vehicle will be operated upon, the date the vehicle will be operated and the weight and dimensions of the load carried by the vehicle. The engineer shall, after consideration of the application, issue a permit without charge with such restrictions and requirements as the engineer deems necessary and appropriate to protect the County roads and the public safety for the operation of the vehicle for one trip or one round trip. When a permit with restrictions is issued to the operator of the vehicle, violation of the restrictions on the permit shall constitute a violation of this chapter. (Ord. 3-1995)
10.12.040 Driving in certain places prohibited.
It shall be unlawful for any person, firm, partnership, corporation or other entity to operate or allow to be operated a motor vehicle which exceeds 15,000 pounds gross vehicle weight on Horseshoe Highway (Main Street), County Road #4, from Lovers Lane (milepost 8.14) to Madrona Street (milepost 8.53). 10.12.050 Duration.
This chapter of the San Juan County Code shall remain in effect for a period of 10 years, ending August 1, 2012. (Ord. 17-2002 § 1; Ord. 3-1995)
10.12.060 Exceptions.
SJCC 10.12.040 shall not prohibit:
A. Delivery or Pickup. Vehicles which are making a delivery or a pickup within Eastsound which is within the area bounded by High School Road, Lovers Lane, Madrona Street and Fishing Bay.
B. Emergency Vehicles. The operation of emergency vehicles, when responding to an emergency.
C. Public Utilities. The operation of trucks owned or operated by the County, public or private utilities, any contractor or material person, while engaged in the repair, maintenance or construction of streets, street improvements, or utilities within Eastsound.
D. Detours. The operation of vehicles upon any officially established detour in any case where such vehicle could lawfully be operated upon the street for which such detour is established. (Ord. 3-1995)
10.12.070 Erection of signs.
The County engineer is authorized and directed to erect signs at such places as he/she deems appropriate giving notice of this chapter. (Ord. 3-1995)
10.12.080 Probable cause requiring weighing of vehicle.
If probable cause exists to believe that a violation of SJCC 10.12.040 has or is occurring, then any duly commissioned police officer may require the driver of said vehicle to proceed to the nearest available weigh scales for the purpose of weighing said vehicle or use the vehicle registration weight to determine if an infraction has occurred. 10.12.090 Temporary additional tonnage permit.
A. Duration, fees and weight limits for temporary additional tonnage permits are those stated in RCW 46.44.095 and as may be later amended by the State Legislature.
B. Temporary additional tonnage permits shall be issued by the County auditor’s office and the fees deposited in the County road fund.
C. The vehicle owner shall certify prior to the issuance of the temporary additional tonnage permit that the primary use of the vehicle will be on County roads.
D. The County will honor temporary additional tonnage permits issued by the state of Washington. (Ord. 3-1995)
10.12.100 Appeal approval.
Any person who applies for a permit under SJCC 10.12.030 and is denied the same may appeal the decision of the County Engineer to the County by requesting, within three days of communication of the Engineer’s decision, a hearing before the commissioners by contacting the clerk of the board, who shall schedule the matter for hearing at the earliest possible meeting of the board. 10.12.110 Violation – Penalty.
A. Any person violating SJCC 10.12.020 or 10.12.030 shall be cited for violation of posted road restrictions per RCW 46.44.080 and subject to a fine as determined by the Supreme Court of Washington and listed in the San Juan County Sheriff’s Department Bail Schedule.
B. Any person violating SJCC 10.12.040 shall be guilty of a misdemeanor. (Ord. 3-1995)
