(1) Notwithstanding any other provision of law, any
person who forcibly assaults, resists, impedes, intimidates, or
interferes with any person while engaged in or on account of the
performance of his or her official duties under this chapter is
guilty of a class C felony and shall be punished by a fine of not
more than five thousand dollars or imprisonment in a state
correctional facility for not more than three years, or both.
(2) Whoever, in the commission of any act described in
subsection (1) of this section, uses a deadly or dangerous weapon
is guilty of a class B felony and shall be punished by a fine of
not more than ten thousand dollars or by imprisonment in a state
correctional facility for not more than ten years, or both.
