(1) A health benefit plan that is issued or renewed on or after
January 1, 2010, and that provides coverage for organ and tissue
transplants, may not permit a separate lifetime limit on
transplants of any less than three hundred fifty thousand
dollars. The lifetime limit on transplants shall apply from one
day prior to the date of the transplant or the date of hospital
admission, for a patient who receives a transplant during the
course of a longer hospital stay, through one hundred days after
the transplant. Donor-related services may apply to the lifetime
limit on transplants any time. The major medical lifetime limit
shall apply to health care services provided before and after
this time period. Benefits provided are subject to all other
terms and conditions of the health benefit plan, including but
not limited to any applicable coinsurances, deductibles, and
copayments.
(2) "Organ and tissue transplant" means the same as defined
under the applicable health benefit plan.
