(1) The Washington state institute for public policy shall
conduct an evaluation of chapter 297, Laws of 1998 to determine:
(a) Whether there has been a reduction in recidivism for mentally ill offenders who are felons or who meet the criteria
specified in *RCW 10.77.090(1)(d) and received mental health
services as a result of the provisions of chapters 10.77 and 71.05 RCW.
(b) The number of nonfelony offenders who have been referred
to competency restoration under *RCW 10.77.090(1)(d)(i)(C) and
the percentage of such offenders who have been restored to
competency within the allotted time for felons, nonfelony
offenders meeting the criteria under *RCW 10.77.090(1)(d), and
the nonfelony offenders who do not meet this criteria.
(c) Whether the information-sharing provisions of chapter
297, Laws of 1998 are adequate to provide necessary information
to the affected parties. The analysis shall include findings as
to whether the flow of information is resulting in the efficient
usage of the information and whether there are revisions in the
flow which would better allow the courts, professional persons,
and parties to proceedings to make better use of the information.
(2) The evaluation shall be presented to the legislature on
or before November 15, 2003.
