King County Code Chapters 11.04, 11.06, 11.12, 11.20, 11.24, 11.28 and 11.32, as now or hereafter amended, are adopted as a part of the Milton Municipal Code except as follows:
A. “Animal control authority” means the city police department or the animal control authority of King County, as agent for the city, acting alone or in concert with other municipalities for enforcement of the animal control laws of the city, King County and the state in the shelter and welfare of animals.
B. Unless the context indicates otherwise, “King County” means the city, except for provisions regarding fees and penalties.
C. “County department of planning” means the Milton planning department.
D. “King County board of appeals” means the Milton hearing examiner; provided, however, that at such time as the city enters into a contract with King County for the enforcement of the animal control ordinance, the contract may provide for the use of the King County board of appeals, in which case “King County board of appeals” means the King County board of appeals.
E. “Title 21(A)” means MMC Title 17.
F. “Ordinance No. 16423” referenced in KCC 11.04.060(E)(1)(a), as now or hereafter amended, means “this ordinance.”
G. “Unincorporated King County” means the city of Milton.
H. A new KCC 11.04.230(O) and (P) are added to KCC Title 11.04 to provide as follows:
11.04.230 Nuisances defined. For purposes of this chapter, nuisances are violations of this chapter and shall be defined as follows:
…
(O) The harboring of any livestock, as defined in MMC 17.08.440, as now or hereafter amended, unless expressly allowed by MMC Title 17.
(P) Dogs running at large. “At large” means off the premises of the owner or keeper and off of a leash; provided, that if both the dog and the owner or other person accompanying the dog have completed organized dog training classes, then the dog may be off leash so long as the dog is under control by verbal voice or signal. This subsection shall not apply to any blind person using a trained service dog. A dog which is permitted to be off a leash within a vehicle shall not be considered at large. Violations of this subsection shall be subject to the penalties imposed under Chapter 11.08 instead of those applicable to this chapter.
I. The last sentence in the definition of “hobby cattery,” “hobby kennel” in KCC 11.04.020 are deleted. (Ord. 1707 § 3, 2007).
