4.05.010 Authority to adopt.
Pursuant to RCW 35.21.180, 35A.11.020 and 35A.21.160, the City adopts by reference Title 23 of the King County Code as the City's code enforcement title. KCC Title 23 shall be given City Clerk's receiving number 184. (Ord. O-00-129 § 1).
4.05.020 Reference to King County titles.
References to Chapter 21A.24 KCC shall mean Chapter 18.60 MVMC, Critical Areas Regulations. References to Chapter 20.24 KCC shall mean Chapter 2.65 MVMC, Hearing Examiner. References to Chapter 20.20 KCC shall mean Chapter 18.110 MVMC, Land Use Permits and Decisions. All appeals to the hearing examiner referenced in KCC Title 23 shall be Process 2 decisions pursuant to MVMC 18.100.040(B). All references to the "county" or "King County" shall refer to the City of Maple Valley. All references to the "prosecuting attorney" shall refer to the City Attorney. All references to county staff shall refer to the City Manager or designee. (Ord. O-00-129 § 2).
4.05.030 Collection of costs and reasonable attorneys' fees authorized.
The City of Maple Valley is authorized by this chapter to recover all costs and reasonable attorneys' fees associated with having to bring an action in superior court to enforce violations of its ordinances and regulations. (Ord. O-00-129 § 3).
4.05.040 Definitions – Abandoned, wrecked, dismantled or inoperative vehicles.
A. "Wrecked, dismantled or inoperative vehicle," as this term is used in KCC 23.10.040, shall mean a motor vehicle or the remains or remnant parts of a motor vehicle which is mechanically inoperative and cannot be made operative without the addition of vital parts or mechanisms or by the application of a substantial amount of labor and is certified by the Community Development Department as meeting at least three of the following requirements:
1. Is three years old or older;
2. Is extensively damaged, such damage including but not limited to any of the following: missing wheels, tires, motor, or transmission;
3. Is apparently inoperable, meaning that the vehicle requires repairs in order to be operated legally on the public roads and is unable to move a distance of 10 feet on level pavement under its own power;
4. Has an approximate fair market value equal only to the approximate value of the scrap in it.
B. An "abandoned vehicle," as this term is used in KCC 23.10.040, shall mean any vehicle left upon the property of another without the consent of the owner of such property for a period of 24 hours or longer, except that a vehicle shall not be considered abandoned if its owner or operator is unable to remove it from the place where it is located and so notifies law enforcement officials and requests assistance.
