5.104.010 Definitions.
A. “Go-kart track” is a place used for the operation of go-karts for public use and entertainment.
B. “Go-kart” is a motor propelled, four-wheel vehicle of not more than five and one-half horsepower used for the purpose of driving. (Ord. 2783-04 § 1, 2004: Ord. 295-74 Ch. 26 § 1, 1974)
5.104.020 Operating conditions—Equipment.
A. No go-kart shall be operated with a horsepower in excess of five and one-half horsepower.
B. All go-karts shall be mechanically controlled in such a manner that they shall not exceed the speed limit of twenty miles per hour and no go-kart shall be operated in excess of said speed.
C. All go-karts shall be equipped with mufflers, to suppress noise, comply with applicable noise regulations, and effectively control noise so as not to be offensive to surrounding property owners.
D. Only licensee’s go-karts shall be allowed on the track.
E. All patrons must wear safety belts and helmets that are state-approved for operation of a motor vehicle while riding in karts.
F. All go-kart tracks shall have crowd control fencing around the entire tracks and pit maintenance area.
G. No go-kart or go-kart track shall be operated in violation of any state or local law, rule or regulation. (Ord. 2783-04 § 3, 2004: Ord. 295-74 Ch. 26 § 2, 1974)
5.104.030 Maintenance—Lighting—Hours of operation.
A. The go-kart track and premises shall be kept in a neat and clean condition.
B. All lighting of a go-kart track shall be so constructed and operated as to prohibit lights from glaring on or across surrounding property.
C. All areas of a go-kart track shall be paved with concrete or asphalt. The parking area shall be paved as well.
D. Each go-kart track shall not be operated after ten p.m. nor before nine a.m. (Ord. 2783-04 § 4, 2004: Ord. 295-74 Ch. 26 § 3, 1974)
5.104.035 License—Application.
Application for a license to operate a go-kart track shall be filed ten days prior to the opening date with the city clerk on forms provided by that official. The applicant shall also contact the police department at least 10 days prior to the opening date. The application shall contain the following information in addition to all requirements set forth in Chapter 5.04 of the Everett Municipal Code, and such other information deemed relevant to the city clerk:
A. The proposed location of the track along with the proposed dimensions of the track, and the number of go-karts to be allowed on the track at any one time; and
B. A list of all employees, including full name, date of birth, physical description, driver’s license number, home address and home phone number. (Ord. 2783-04 § 2, 2004)
5.104.040 License required—Licensing fees.
It is unlawful for any person, firm or corporation to keep, conduct, maintain, manage or operate or cause to be conducted, managed, maintained or operated either as owner, lessee, manager or agent, or in any other capacity, a go-kart track unless he shall have in full force and effect a license for such purpose issued by the city. The licensing fees for a go-kart track shall be five hundred dollars per year or forty dollars per day. (Ord. 2783-04 § 5, 2004: Ord. 295-74 Ch. 26 § 4, 1974)
5.104.050 Number of go-karts on track.
The license shall limit the number of go-karts permitted on the track at any one time to a number that is in proportion to the size of the track. It is unlawful for any licensee to permit the operation of go-karts on the licensed track in excess of the number for which the premises is licensed. 5.104.060 Liability insurance.
Each licensee shall maintain commercial general liability insurance with limits no less than two million dollars each occurrence. The insurance policy shall be endorsed to name the city of Everett, its employees and agents as additional insureds. A certificate of insurance with the amendatory endorsement must be provided by the license applicant and approved by the city prior to issuance of license. The license herein granted shall be terminated at any time the insurance policy is cancelled or terminated. (Ord. 2783-04 § 7, 2004: Ord. 295-74 Ch. 26 § 6, 1974)
