MISCELLANEOUS DRIVING AND TRAFFIC RULES

8.32.010 Driving through funeral or other procession.
No operator of a vehicle shall drive between or follow in such close proximity as to appear to be a part of any vehicles comprising a funeral or other authorized procession while they are in motion and when such vehicles are conspicuously designated as required in this title. The provision shall not apply at intersections where traffic is controlled by traffic control signals unless a police officer is present at such intersections to direct traffic so as to preserve the continuity of the funeral or other authorized procession. 8.32.020 Use of skateboards, roller skates and similar devices restricted.
Repealed by Ord. 2846.
8.32.025 Playing in streets prohibited.
A. When adequate signs have been posted, no person shall play in the public streets by means of throwing, batting or catching any ball or other object.
B. The traffic engineer is authorized to erect signs prohibiting the conduct specified in subsection A of this section along those streets or portions of streets where appropriate, considering the following factors:
1. The number of vehicles using the street or portion of the street.
2. The speed of vehicles utilizing the street.
3. The width of the street.
4. The time of day the street has been utilized for play.
5. The number of people using the street for play.
6. The danger of accidents occurring as a result of play in the streets. [Ord. 2373, 1983].
8.32.030 One-way streets and alleys.
Upon those streets and parts of streets and in those alleys described in ECC 8.64.010, vehicular traffic shall move only in the indicated direction when signs indicating the direction of traffic are erected and maintained at every intersection where movement in the opposite direction is prohibited, and a vehicle passing around a rotary traffic island shall be driven only to the right of such island. 8.32.040 Railroad trains not to block streets.
It is unlawful for the directing officer or the operator of any railroad train to direct the operation of or to operate the same in such a manner as to prevent the use of any street for purposes of travel for a period of time longer than five minutes, except that this provision shall not apply to trains or cars in motion other than those engaged in switching. 8.32.050 Compression brakes prohibited.
No person shall use motor vehicle brakes which are in any way activated or operated by the compression of the engine of any such motor vehicle or any component part thereof.
A. It shall be an affirmative defense to prosecution under this section that compression brakes were applied in an emergency and were necessary for the protection of persons and/or property.
B. Bona fide emergency vehicles owned by a public entity and equipped and licensed in compliance with state law shall be exempt from the provisions of this section. [Ord. 3186 § 1, 1998; Ord. 1986 § 1, 1978].
8.32.060 Alcoholic beverages in vehicles.
It is a traffic infraction:
A. For any person to drink any alcoholic beverage in a motor vehicle when the vehicle is upon a highway;
B. For any person to have in his possession while in a motor vehicle upon a highway, a bottle, can, or other receptacle containing alcoholic beverage if the container has been opened or a seal broken or the contents partially removed; or
C. For the registered owner of a motor vehicle, or the driver if the registered owner is not then present in the vehicle, to keep in a motor vehicle when the vehicle is upon a highway, a bottle, can, or other receptacle containing an alcoholic beverage which has been opened or a seal broken or the contents partially removed, unless the container is kept in the trunk of the vehicle or in some other area of the vehicle not normally occupied by the driver or passengers if the vehicle does not have a trunk. A utility compartment or glove compartment is deemed to be within the area occupied by the driver and passengers.
This section does not apply to a public conveyance that has been commercially chartered for group use or to the living quarters of a motor home or camper or, except as otherwise provided by the Edmonds City Code, to any passenger for compensation in a for-hire vehicle licensed under city, county, or state law. 8.32.070 Avoiding compliance with traffic devices prohibited.
A. No person shall drive a motor vehicle over private property in order to avoid compliance with a traffic-control device.
B. Any person violating the provisions of this section shall have committed a traffic infraction, punishable by a maximum fine of $250.00. [Ord. 2788 § 1, 1990].
8.32.080 Penalty.
Unless otherwise provided by state statute, adopted by reference, court rule or by this municipal code, any person violating any provision of this chapter shall be guilty of a traffic infraction and shall be sentenced to a fine not to exceed $1,000 for each offense. [Ord. 2853 § 51, 1991].
