16.120.010 Purpose.

It is the purpose of this chapter to set forth the procedures, submittal requirements and criteria for final plats. (Ord. 99-008 § 1(E) (part), 1999)

16.120.020 Applicability.

The provisions of this chapter shall apply to all applications to all final preliminary plat approvals, both short plats and subdivisions, granted pursuant to Chapter 16.115 BGMC. (Ord. 99-008 § 1(E) (part), 1999)

16.120.030 Procedures.

Final plat applications shall be processed as a Type I land use action, pursuant to BGMC 17.200.060; provided, that approval for all final plats shall be solely by the city council based upon a recommendation of the planning director; and further provided, that final plats for short plat applications may be approved by the planning director. Upon findings that the subdivision proposed for final plat approval conforms to all terms of the preliminary plat approval, meets the requirements of Chapter 58.17 RCW and all other applicable state laws, this title and all applicable local laws, council shall authorize the planning director and city engineer to sign the face of the final plat. 16.120.040 Submittal requirements.

In addition to the submittal requirements for a Type I land use action identified in BGMC 17.200.050, applications for final plat shall include the following:

A.    The plat shall consist of one or more pages of a size acceptable to the recording authority. The plat shall be clearly and legibly drawn on black and white bond paper or equivalent approved material for review and approval by staff and the city council and shall be clearly and legibly drawn on stable-base polyester film or equivalent approved material for city signature. All drawing and lettering shall be in permanent black ink or an approved equivalent;

B.    The perimeter of the subdivision shall be depicted with heavier lines than appear elsewhere on the plat. The minimum scale shall be one inch equals fifty feet, unless the planning director approves another scale. A marginal line shall be drawn completely around each sheet, leaving an entirely blank margin of three inches on the left side and one inch on the remaining sides;

C.    The name of the subdivision, graphic scale and north point;

D.    An accurate map of the subdivided land, based upon a complete survey by a licensed surveyor;

E.    All section, township, municipal and county lines lying within or adjacent to the subdivision;

F.    The location of all monuments or other evidence used as ties to establish the subdivision’s boundaries, and all permanent monuments with linear dimensions;

G.    The boundary of the subdivision with complete bearings and linear distances;

H.    The length and bearings of all straight lines and the radii, arcs and semitangents of all curves;

I.    The length of all lot lines, together with bearings and other data necessary for the location of any lot line in the field;

J.    The location, right-of-way width, pavement width, centerline and name or number of all streets and alleys within and adjoining the subdivision;

K.    Numbers assigned to all lots, indication of the acreage and/or square footage of each lot, and letters assigned to all blocks within the subdivision. A house address system shall be provided by the city; provided, however, that an index system shall be shown on the plat to allow assignment of house numbers by the city;

L.    Certification on the face of the plat by a registered land surveyor who made, or under whose supervision was made, the survey of the subdivision in substantially the following language:

I, _____________, registered as a land surveyor by the state of Washington, certify that this plat is based on an actual survey of the land described herein, conducted by or under my supervision, during the period of _________ through ________; that the distances, courses and angles are shown thereon correctly, and that monuments other than those monuments approved for setting at a later date have been set and lot corners staked on the ground as depicted on the plat.

M.    Signature line and a statement of approval on the face of the plat signed by the city engineer as to survey data, layout of roads, alleys and easements, road names and numbers, and the design and/or construction of protective improvements, bridges, sewage and drainage systems;

N.    Signature line and a statement of approval on the face of the plat signed by the planning director that the subdivision conforms to the comprehensive plan and applicable zoning regulations and requirements;

O.    Signature line and a statement on the face of the plat bearing the typed or printed names of all persons having an interest in the subdivided land, signed by the persons and acknowledged by them before a notary public, consenting to the subdivision of the land and reciting a dedication by them of all land shown on the plat to be dedicated for public uses, and a waiver by them and their successors of all claims for damages against any governmental authority arising from the construction and maintenance of public facilities and public property within the subdivision;

P.    Signature line and statement on the face of the plat by the Clark County treasurer that all taxes one year in advance on all unimproved property in each proposed subdivision and delinquent assessments for which the land within the subdivision may be liable have been duly paid, satisfied or discharged;

Q.    Signature line and statement on the face of the plat by the Clark County auditor for filing and recording of said plat;

R.    Notations of any survey discrepancies, other pertinent information pertaining to the platting of the land and any information that may have been specified as a condition of approval. (Ord. 00-023 § 1(A), 2000; Ord. 99-008 § 1(E) (part), 1999)

16.120.050 Additional final plat application requirements.

A.    In addition to a completed application form furnished by the planning director, seven copies of the final plat with all data thereon, and the specified fees and one reduced-scale reproducible copy, the applicant for final plat approval shall submit the following information:

1.    A title insurance report confirming that the title of the land in the proposed subdivision is vested in the name of the owners whose signatures appear on the plat’s certificate;

2.    If public improvements are not fully complete and accepted by the city, an acceptable security guaranteeing the construction of such improvements shall be submitted in a form acceptable to the city attorney and in an amount and with sureties commensurate with improvements to be completed plus an additional twenty-five percent for administrative costs, securing to the city the construction and installation of the required improvements within a time fixed by the planning director which shall include a reasonable amount of time to complete said improvements but shall not exceed eighteen months. Such guarantee shall be in the form of an escrow account, letter of credit or other form acceptable to the planning director that provides the city with the necessary funds to complete the improvements should they not be constructed within the required time frame;

3.    A maintenance bond in the amount of twenty percent retainage of the actual construction cost to the city for a two-year period after construction of the required improvements is approved and accepted by the city, securing to the city the maintenance and/or installation of any corrections which must be made to the subdivision development;

4.    “As-built” improvement drawings prepared and stamped by a professional design engineer or three copies of signed engineer drawings if construction is not complete;

5.    Computation data for all lots, streets and easements located within the plat;

6.    A written itemized construction cost estimate for all required public improvements in a form acceptable to the city engineer or designee. Such construction cost estimate shall be the basis for the calculation of any required performance or maintenance security and shall be reviewed and approved by the city engineer or designee prior to the city’s acceptance of any submitted performance or maintenance security;

7.    A detailed schedule for the completion of any required improvements that are subject to a performance guarantee.

B.    Failure of an applicant to submit all required application materials shall be considered a lack of compliance with this section, and the planning director may withhold the application from further consideration until such time as the application is complete. 16.120.060 Criteria.

The following criteria shall be considered when the city council reviews a final plat:

A.    Whether conditions imposed when the preliminary plat was approved have been met;

B.    Whether the security, if there is one, by its essential terms assures completion and/or maintenance of improvements;

C.    Whether the final plat is in conformance with the city’s zoning regulations and all other applicable land use regulations;

D.    A final plat shall not be approved until the city council finds that the final plat conforms to the proposed preliminary plat and then any conditions imposed. (Ord. 04-023 § 6, 2004: Ord. 99-008 § 1(E) (part), 1999)

16.120.070 Recording time limit.

A.    The final plat shall be recorded with the Clark County auditor within thirty days of approval by the city. It shall be the responsibility of the applicant to record the plat with the county auditor.

B.    Upon recording of the final plat with the Clark County auditor, the applicant shall submit three full size copies of the actual recorded mylar, one reduced eleven-inch by seventeen-inch copy of the actual recorded mylar and one copy of the actual recorded plat at a one inch equals three hundred feet scale inclusive of book and page number, to the planning director. No building permit shall be issued until a copy of the recorded plat is received by the city. (Ord. 00-023 § 1(B), 2000; Ord. 99-008 § 1(E) (part), 1999)

16.120.080 Acceptance of security in lieu of construction.

Acceptance of a security in lieu of the construction of public improvements as outlined in BGMC 16.120.050 (A)(2) shall be allowed subject to the following:

A.    Acceptance of securities in lieu of completed public improvements shall be permitted only when completion of improvements prior to final plat approval is impracticable (i.e., due to construction season delays or other factors beyond the control of the applicant) or when delay of such improvements is of benefit to the city.

B.    Construction of structures or establishment of uses on lots shall not be permitted until the improvements guaranteed by the security are installed and accepted by the city. The planning director may allow for a limited amount of construction where the remaining items to be constructed are not necessary to protect life, health and safety. (Ord. 04-023 § 7, 2004)
