10.14.005 No parking areas—Limited parking areas—Bike lanes.
The city council may from time to time establish certain designated areas wherein parking shall be prohibited or limited but not prohibited entirely, or where bike lanes may be established which result in no parking being allowed. These restrictions and designated areas shall be adopted by the city council by resolution and upon recommendation by the engineer of the city of Battle Ground or the public works director. After adoption the city engineer is authorized and directed to erect signs in each designated area giving notice of the parking time limits or that parking is prohibited. (Ord. 11-01 § 2, 2011)
10.14.040 Parking on one side of street.
There are hereby established certain designated areas wherein parking is prohibited on one side of the street pursuant to Table 12.116.040C, “Local Street B,” where the paving width is twenty-two feet curb to curb within an eight-foot parking shoulder on one side only. Appropriate signs shall be posted on the restricted site giving notice of the restriction. (Ord. 03-018 § 4, 2003)
10.14.045 Parking in alleys.
Areas established as alleys pursuant to Table 12.116.040D, “One-Way Alleys” and “Two-Way Alleys,” are designated as no parking and appropriate signs shall be posted on the restricted site giving notice of the restriction. (Ord. 09-08 § 2, 2009)
10.14.050 Public safety.
There shall be established certain designated areas wherein parking is prohibited due to public safety issues which result in needing to prohibit parking fifteen feet from the corner of the street or entrance way. Appropriate signs shall be posted at the restricted site giving notice of the restrictions. Said restrictions are:
A. Either side of each driveway accessing the City Hall parking lot from S.W. 1st Street located at 109 S.W. 1st Street. (Ord. 03-018 § 5, 2003)
10.14.055 Marked parking spaces.
Upon those streets or in city-owned parking lots where parking spaces are designated by lines or markings painted on the street or curb, it is unlawful:
A. To park more than one vehicle in a marked parking space;
B. To park any vehicle across or over any line or marking designating a parking space;
C. To park a vehicle in such a manner that it is not entirely within the parking space designated by the laws or marking; or
D. To park any vehicle in an angle parking space with the back of the vehicle facing the curb. (Ord. 10-14 § 3, 2010: Ord. 10-10 § 2, 2010)
10.14.060 Truck parking regulations.
There are hereby established certain truck parking regulations throughout the city of Battle Ground. Said regulations are:
A. It is unlawful for any person, business, firm or corporation to park or cause to be parked any semitrailer or truck in excess of twelve thousand pounds gross weight from the hours of 6:00 p.m. to 6:00 a.m. along Main Street, and along the cross streets intersecting Main Street running from S.E. and S.W. 1st Street north to Main Street, and running from N.E. 1st Street south to Main Street.
B. For the purpose of this chapter, the following words and phrases shall have the following designated meanings unless a different meaning is expressly provided:
1. “Residential area” means any area of the city of Battle Ground that is zoned as residential.
2. “Trailer” means any vehicle without motive power, designed for carrying persons or property on its own structure, and to be drawn by a vehicle with motor power. The term “trailer” includes trailer coach, semi-trailer or utility trailer, but does not include recreational vehicles as defined herein.
3. “Truck” means any motor vehicle designed primarily for the transportation of property.
4. “Recreational vehicle” means a vehicular-type unit primarily designed as temporary living quarters for recreational, camping or travel use which either has its own motive power or is mounted on or drawn by another vehicle. The basic entities or recreational vehicles are: travel trailer, camping trailer, truck camper and motor home.
C. No person shall park or leave standing on any public right-of-way in any residential area of the city of Battle Ground any of the following:
1. A truck with a gross weight capacity in excess of twelve thousand pounds;
2. A trailer in excess of twenty feet in length;
3. The provisions of this section shall not apply to any vehicle which is parked or left standing expressly for the purpose of loading or unloading, providing the vision of traffic is not obstructed. For the purposes of this section, a reasonable amount of time on any day or successive days shall be allowed for loading and unloading; the amount of time is to be determined according to the nature and extent of the loading and unloading operation.
D. No recreational vehicle will be allowed to park or be stored permanently in a public right-of-way in a residential area of the city of Battle Ground. For the purposes of this section, “permanent” shall be defined as more than ten days within a one-hundred-twenty-day period of successive days.
E. No person shall park or leave standing on any public right-of-way any truck weighing more than twelve thousand pounds gross vehicle weight on S.W. 1st Street from South Parkway Avenue to S.W. 7th Avenue on both sides of the street, on S.W. 7th Avenue from West Main Street to the entrance of Battle Ground Mobile Estates on both sides of the street, and on S.E. Grace Avenue from one thousand three hundred feet south of the centerline of S.E. Rasmussen Boulevard to one thousand nine hundred and fifty feet south of the centerline of S.E. Rasmussen Boulevard on the west side of the street.
F. No person shall park or leave standing in any public right-of-way in any area of the city any trailer that is not attached to a tractor. (Ord. 07-08 § 2, 2007: Ord. 03-018 § 6, 2003)
10.14.070 Parking in city lots.
A. All spaces in parking lots owned and operated by the city of Battle Ground shall be restricted to parking of motor vehicles of employees and patrons of the city or its tenants while engaged in business all hours each day of the week.
B. Each lot or area designated for employee or restricted public parking shall be identified by a sign or signs visible to incoming drivers advising them whether the lot or area is designated for employee or restrictive public parking, the maximum time period allowed for parking, advising that any unauthorized vehicles will be cited and/or towed and impounded at owner’s expense and advising how owners of unauthorized vehicles may ascertain the whereabouts of their vehicles.
C. Vehicles utilizing city park parking lots maintained by the city may not be left unattended in the parking areas unless the operators of said vehicles are patronizing the park.
D. Any motor vehicle found to be in violation of the foregoing restrictions may be removed from the parking lot and towed to a storage or impound lot at the sole expense of the owner of the motor vehicle found to be in violation. (Ord. 10-14 § 1, 2010: Ord. 10-10 § 1, 2010: Ord. 03-018 § 7, 2003)
10.14.080 No parking during construction.
It shall be unlawful to park any motor vehicle on any street within the city of Battle Ground after notice has been given and signs posted indicating that the designated area on the street is subject to a paving or construction project.
In addition to the penalties provided hereinafter, any motor vehicle found to be in violation of this section shall be towed by the city at the sole expense of the vehicle owner. The vehicle will be towed to a storage facility only after the city has given twenty-four-hour notice to the motor vehicle owner. Notice shall be by a telephone call to the registered owner or by placing a notice conspicuously on the motor vehicle. (Ord. 03-018 § 8, 2003)
10.14.090 Violation—Penalty.
Any violation of this chapter shall be an infraction and punishable by a fine not to exceed two hundred fifty dollars. (Ord. 10-14 § 2, 2010: Ord. 03-018 § 9, 2003)
10.14.100 Resolutions superseded.
This chapter shall supersede and replace any resolutions creating no parking zones or restricted zones within the city of Battle Ground. (Ord. 03-018 § 10, 2003)
