FIREWORKS AND EXPLOSIVES

9.52.010 Permitted when.

It is unlawful for any person to fire or discharge any squib, firecracker, gun powder, or other combustible substance, or fireworks or common fireworks as defined in Chapter 70.77 RCW within the city of Battle Ground at times other than permitted by RCW 70.77.395 and 70.77.311 or other applicable Washington state law or as either statute may be hereafter amended. 9.52.020 License to sell—Required—Issuance—Fee.

It is unlawful for any firm, corporation, or person to sell, trade or offer to sell, trade or exchange fireworks, firecrackers or other combustible substances, explosives or Fourth of July fireworks, unless the same are declared safe by the state of Washington department governing fireworks and unless a license is first obtained from the planning director for the city of Battle Ground. The license to sell fireworks shall be issued to service clubs, religious or charitable organizations located in or benefiting the citizens of the city of Battle Ground. For the purpose of this chapter, service clubs, religious organizations and charitable organizations shall be defined as an organization designated as a nonprofit entity by the United States Internal Revenue Service, a primary organization with an identified and accepted public purpose, and/or an organization created and operated under the auspices of a primary organization with an identified and accepted public purpose. Only one stand per organization to which a license is issued to shall be authorized. The cost of the license shall be the sum of ten dollars per stand per year. Applications for licenses shall be made a minimum of thirty days before the first authorized day of the sale of fireworks. Each permitted stand shall provide a sign displaying the name of the service club, religious organization or charitable organization benefiting from the sale that is a minimum of twenty square feet in area and displayed in such a manner as to be visible to all those visiting the stand. Fireworks shall only be sold during those days and hours provided by RCW 70.77.395 as it presently exists or as it may be hereafter amended. 9.52.030 Violation—Penalty.
