ASSAULT

9.06.010 Assault in the fourth degree.
A. A person is guilty of assault in the fourth degree if, under circumstances not amounting to assault in the first, second or third degree, as defined in RCW 9A.36.011, 9A.36.021 and 9A.36.031, or custodial assault, he or she:
1. Intentionally causes bodily harm by unlawfully touching or striking another person; or
2. Attempts by force or violence to cause bodily harm to another person; or
3. Intentionally places or attempts to place another person in fear or apprehension of bodily harm by an act, word or threat.
B. Assault in the fourth degree is a gross misdemeanor. (Ord. 97-844 § 1, 1997)
