8.20.010 Definitions.
As used in this chapter, the following terms shall have the following meanings:
A. “Abate” means to do away with or nullify or put an end to.
B. “Continue” means not to remove or terminate.
C. “Owner” means the person in actual control of real property or his agent, whether such control is based on legal or equitable title or any other interest entitling the holder to possession and, for purposes of liability for payment pursuant to the provisions of this chapter, means the holder of legal or equitable title or the holder of an easement if said easement holder has the right to control or limit the growth of vegetation within the boundary of the easement.
D. “Person” means an individual, partnership, corporation, firm or other association, including municipal corporations, public utilities, private utilities and governmental agencies.
E. “Weeds” means thistles, nettles or noxious plants which have been determined by the State Noxious Weed Control Board to be injurious to crops, livestock or other property and which are included for purposes of control on the county noxious weed list, or, if not included on the county noxious weed list, have been designated for control by resolution of the city council. 8.20.020 Prohibited conditions.
Any owner of property within the city shall remove or destroy, and shall not allow to continue, the following, if located on his or her property:
A. All trees, plants, shrubs, or vegetation or parts thereof which overhang any sidewalk or street or which are growing thereon in such manner as to obstruct or impair the free and full use of the sidewalk or street by the public;
B. All grass, weeds, shrubs, bushes, trees or vegetation growing or which have grown and died, which are a fire hazard or menace to public health, safety or welfare;
C. All noxious weeds;
D. Any shrubs, bushes, trees or vegetation growing in such a location or in such a manner as to damage or potentially damage city property, including streets, sidewalks, signs or utilities by means of growing branches, trunks and/or roots;
E. All debris, refuse, rubbish, sawdust, shavings or other waste or unsightly material or inflammable material of any sort, including but not limited to any parts of any dead animals or fish, or any unsound, putrid or unwholesome substance, which are declared to be a menace to the public health, safety and welfare of the citizens of the city. 8.20.090 Penalties.
Violations of or failure to comply with any provisions of this chapter shall be enforced under Chapter 8.34 BGMC. (Ord. 03-017 § 6, 2003: Ord. 540 § 9, 1985)
