3.04.010 Community education fund—Established—Purpose.

There is established a community education fund for fostering and assisting in the education of the community of the city of Battle Ground, including the acquisition of necessary housing, facilities, services, and any other materials or items as may be necessary for community education. (Ord. 251 § 1, 1975)

3.04.020 Community education fund—Transferral of other funds to.

There are transferred to the community education fund, for such municipal facilities and services, funds obtained from federal revenue sharing funds. It is further ordered that, from time to time by appropriate motion and resolution, there may be transferred to the community education fund, in addition to federal sharing funds, such other funds as may be available and as the city council of Battle Ground shall direct. (Ord. 251 § 2, 1975)

3.04.030 Parks and recreation fund—Established—Purpose.

There is established a parks and recreation fund for the acquisition of land for parks and construction and installation of park and recreation facilities including machine equipment, materials, and any other items, contractual services, engineering, utilities, and other services and facilities as may be necessary for the establishment of any parks or recreation centers, and as may be necessary for the operation thereof. (Ord. 250 § 1, 1975)

3.04.040 Parks and recreation fund—Transferral of other funds to.

There are transferred to the parks and recreation fund for such municipal facilities and services, funds obtained from federal revenue sharing funds. It is further ordered that, from time to time by appropriate motion and resolution, there may be transferred to the parks and recreation fund, in addition to federal sharing funds, such other funds as may be available, and as the city council of Battle Ground shall direct. 3.04.050 Revenue sharing fund—Established—Source of income.

There is established a fund to be known as the revenue sharing fund and the only funds or income that shall be paid into said revenue sharing fund shall be revenues and funds received from the United States government under its revenue sharing program. (Ord. 195 § 1, 1973)

3.04.060 Revenue sharing fund—Expenditures.

All expenditures made by the revenue sharing fund shall be in accordance with the prevailing and applicable regulations pertaining to expenditure of funds by a municipal corporation; provided, that all moneys and expenditures disbursed from the fund shall be accounted for separately so that the purposes for the expenditures and the amounts expended shall be identifiable; provided further, that the funds shall be expended in accordance with any applicable rules or requirements that may be set or established for revenue sharing funds. 3.04.070 Treasurer/finance director’s revolving cash fund—Established—Amount.

There is established a revolving cash fund in the office of the city treasurer/finance director, not to exceed the amount of three hundred dollars. (Ord. 02-009 § 11, 2002: Ord. 230 § 1, 1975)

3.04.080 Treasurer/finance director’s revolving cash fund—Termination upon notice by council.

This revolving cash fund may be terminated at any time upon the duly adopted motion by the council of the city of Battle Ground, Washington. (Ord. 02-009 § 12, 2002: Ord. 230 § 2, 1975)

3.04.090 Treasurer/finance director’s revolving cash fund—Increase upon motion by council.

The revolving cash fund may be increased at any time upon the duly adopted motion by the council of the city Battle Ground, Washington. (Ord. 02-009 § 13, 2002: Ord. 230 § 3, 1975)

3.04.100 Police department’s revolving cash fund—Established—Amount.

There is established a revolving cash fund in the office of the police department, not to exceed the amount of fifty dollars. (Ord. 254 § 1, 1976)

3.04.110 Police department’s revolving cash fund—Termination upon notice by council.

This revolving cash fund may be terminated at any time upon a duly adopted motion by the council of the city of Battle Ground, Washington. (Ord. 254 § 2, 1976)

3.04.120 Police department’s revolving cash fund—Increase upon motion by council.

The revolving cash fund may be increased at any time upon a duly adopted motion by the council of the city of Battle Ground, Washington. (Ord. 254 § 3, 1976)

3.04.130 Water and sewer warrant redemption fund—Established—Purpose—Source of moneys.

There is established and created a fund to be designated as the water and sewer warrant redemption fund, which fund shall be drawn upon only for the payment and retirement of water and sewer warrants. There shall be allocated to said fund such sums as the council of the city of Battle Ground shall designate from time to time from the operations of the water and sewer departments or from such other sources as the council may by motion or resolution designate. (Ord. 87 § 1, 1964)

3.04.135 Water and sewer improvement reserve fund.

A.    There is established a cumulative fund for the construction, improvement, expansion, and acquisition of municipal water and sewer facilities. Said funds shall be used for any purpose in connection with the expansion and improvement of the city of Battle Ground water and sewer facilities, including but not limited to the acquisition of land, machinery, equipment, contractual services, and materials as may be necessary for such facilities. Said fund shall be known as the water/sewer improvement reserve fund.

B.    All previous budget appropriations for water and sewer improvement reserve funds or expansion are recalled from whatever fund they may have been transferred to, to the extent such funds are unexpended, and are transferred to the water/sewer improvement reserve fund.

C.    The fund shall be a cumulative reserve fund and shall not lapse at the end of the fiscal year. Any funds in said fund need not be reappropriated until such fund is abandoned or all funds are totally expended. (Ord. 350 §§ 1 — 3, 1979)

3.04.140 Cumulative reserve fund—Established—Purpose.

There is established a cumulative reserve fund for the construction of municipal facilities, including the housing and installation of facilities for the City Hall complex, housing and facilities for the fire department, police department, and any other municipal office, agency, or department of the city of Battle Ground. Construction for such housing and facilities shall include funds for the acquisition of land, machinery, equipment, materials, and any other items, contractual services, engineering, or utilities, as may be necessary for the establishment of any facilities for any municipal purposes. 3.04.150 Cumulative reserve fund—Transferral of other funds to.

There are transferred to the cumulative reserve fund, for such municipal facilities and services, funds obtained from federal revenue sharing funds. It is further ordered that, from time to time by appropriate motion and resolution, there may be transferred to the cumulative reserve fund, in addition to federal sharing funds, such other funds as may be available, and as the council of the city of Battle Ground shall direct. 3.04.160 Antirecessional fiscal assistance fund—Established.

There is established an antirecessional fiscal assistance fund, which is to be used for the maintenance of basic services customarily provided to persons in the Battle Ground area, but which is not to be used for the acquisition of supplies and materials or for construction, except for normal supplies or repairs necessary to maintain basic services. (Ord. 320 § 1, 1978)

3.04.170 Antirecessional fiscal assistance fund—Transferral of other funds.

There is transferred to said antirecessional fiscal assistance fund, such funds as may be obtained from the federal government under the Intragovernmental Anti-Recessional Assistance Act of 1977, and the Public Works Employment Act of 1976. (Ord. 320 § 2, 1978)

3.04.180 Claims fund—Created.

Under the authority of RCW 35A.21.160 and RCW 35.21.085 of the Revised Code of Washington, there is created for the city of Battle Ground a special fund to be designated as the claims fund into which may be paid moneys from time to time from any funds which are available and upon which warrants may be issued and paid in payment of claims against the city for any purpose. 3.04.185 Claims fund—Accounts.

The accounts of the city of Battle Ground shall be so kept that they shall show the department or departments and respective amounts for which the warrants are issued and paid. (Ord. 389 § 2, 1980)

3.04.190 Payroll fund—Created.

Pursuant to RCW 35A.21.160 and RCW 35.21.085 of the Revised Code of Washington, there is created for the city of Battle Ground a special fund to be designated as the payroll fund into which may be placed moneys from time to time as directed by the city council from any funds available, and upon which warrants may be drawn and cashed for the purpose of paying any moneys due city employees for salaries and wages. (Ord. 390 § 1, 1980)

3.04.195 Payroll fund—Accounts.

The accounts of the city shall be so kept that they shall show the department or departments and respective amounts for which the warrants are issued and paid. (Ord. 390 § 2, 1980)

3.04.200 Police department cumulative reserve fund.

A.    There is established a cumulative reserve fund for maintenance and purchase of equipment for the Battle Ground police department, including but not limited to radios, vehicles and other equipment. The fund shall be known as the police department cumulative reserve fund.

B.    All previous budget appropriations for the police department cumulative reserve fund and police vehicle reserve are hereby recalled from whatever fund they may have been transferred to or budgeted in to the extent that such funds are unexpended and transferred to the police department cumulative reserve fund.

C.    Said fund should be a cumulative reserve fund and shall not lapse at the end of the fiscal year. Any monetary amounts in said fund at the end of the fiscal year need not be reappropriated until such fund is abandoned or all funds are totally expended. 3.04.210 Cedars sewer improvement reserve fund.

A.    There is established a cumulative reserve fund for the maintenance, improvement, replacement and construction of sanitary sewers directly serving Cedars East Subdivision.

B.    Each living unit in Cedars East Subdivision shall be billed at the rate of four dollars per month per unit. This amount shall be increased by the city by the same percentage of increase that the assessment of all other outside-city users of the Battle Ground system is increased.

C.    All previous budget appropriations for the Cedars East sewer maintenance are recalled from whatever fund they may have been transferred to, to the extent they are unexpended, and are transferred to the Cedars sewer improvement reserve.

D.    The fund shall be a cumulative reserve fund and shall not lapse at the end of the fiscal year. Any funds in the fund need not be reappropriated until such fund is abandoned or all funds are totally expended. (Ord. 462 §§ 1 — 4)

3.04.220 Storm drainage utility fund.

A.    There is created a fund to be known as the storm drainage utility fund. All revenues, assessments and other charges collected by the utility, or otherwise received for drainage purposes or attributable to the operation and maintenance of the utility, and all loans to or grants or funds received for its construction, improvement and operation, shall be deposited in the storm drainage utility fund. All disbursements for costs of planning, constructing, acquiring, maintaining, operating and improving the drainage utility facilities, whether such facilities are natural, constructed or both, and administering the utility shall be made from the storm drainage utility fund.

B.    The city may create, at such time or times as it deems appropriate, any other funds necessary to the administration of the storm drainage utility and may designate the revenues to be placed therein and the purpose or purposes of such funds which may be the same as one, some or all of the purposes designated in this section as the purposes of the storm drainage utility fund and such purposes shall then be transferred to such newly created fund. 3.04.230 Drug investigation fund.

A.    There is hereby established a drug investigation revolving fund for use in investigating criminal drug activity in the city of Battle Ground and Clark County as outlined in the Cities Interlocal Drug Agreement. This fund shall be a cumulative reserve fund and shall not lapse at the end of the fiscal year.

B.    There is hereby transferred to the drug investigation revolving fund one hundred ninety-two dollars and thirty-six cents cash on hand in the property room of the police department. It is further ordered, that from time to time by appropriate motion or resolution, there may be transferred to the drug investigation fund, such funds as may be available, and as the city council of Battle Ground shall direct.

C.    All moneys in the drug investigation revolving fund shall be in the custody of the chief of police. (Ord. 486 § 1, 1983)

3.04.240 Revolving fund.

A.    There is hereby established a revolving cash fund in the municipal court department, not to exceed the amount of one hundred dollars. This shall be a cumulative reserve fund, and shall be used to give change to municipal court payors, and shall not lapse at the end of the fiscal year.

B.    This revolving cash fund may be terminated, increased or decreased at any time upon a duly adopted motion by the council of the city of Battle Ground, Washington. (Ord. 487 § 1, 1983)

3.04.250 Fire department cumulative reserve fund.

There is established a cumulative reserve fund for maintenance and purchase of equipment for the Battle Ground fire department, including, but not limited to, firefighting equipment, vehicles, radios, and other equipment. Said fund shall be known as the “fire department cumulative reserve fund.” (Ord. 511 § 1, 1984)

3.04.260 Parks board cumulative reserve fund.

There is established a cumulative reserve fund for maintenance and improvements of parks in the city of Battle Ground, and for the purchase and maintenance of equipment for city of Battle Ground parks, which fund shall be a cumulative reserve fund. Said fund shall be known as the “parks board cumulative reserve fund.” (Ord. 511 § 2, 1984)

3.04.270 LEOFF I medical cumulative reserve fund.

There is hereby established a cumulative reserve fund for payment of medical insurance and expenses for retiring LEOFF I employees. Said fund shall be known as the “LEOFF I medical reserve fund,” and shall not lapse at the end of the fiscal year. (Ord. 522 § 1, 1984)

3.04.280 West Main Street design and construction fund.

There is hereby established a cumulative reserve fund for design and construction of West Main Street in the city of Battle Ground, which fund shall be a cumulative reserve fund, and shall not lapse at the end of the fiscal year. Said fund shall be known as the “West Main Street design and construction cumulative reserve fund.” (Ord. 522 § 2, 1984)

3.04.290 Storm drainage construction fund.

There is hereby established a cumulative reserve fund for storm drainage construction and improvements within the city of Battle Ground, and for all expenses incident thereto. The fund shall be known as “storm drainage construction fund,” and shall not lapse at the end of the fiscal year. (Ord. 527 § 1, 1984)

3.04.300 Local improvement guaranty fund—Created.

Pursuant to Chapter 35.54 of the Revised Code of Washington, there is created a fund in the city to be known and designated as the “Battle Ground Local Improvement Guaranty Fund” (the “Guaranty Fund”) for the purpose of guaranteeing, to the extent of such guaranty fund in the manner provided by law and this chapter, the payment of local improvements bonds and warrants (and to the extent permitted by law any other obligations) hereafter issued to pay the cost of improvements constructed in all local improvement districts of the city. (Ord. 609 § 1, 1987)

3.04.310 Local improvement guaranty fund—Annual deposits.

In order to maintain the guaranty fund, there shall be deposited annually in the guaranty fund, from money available in the general fund or money received from another municipality pursuant to an interlocal cooperation agreement, such sums as may be necessary to establish and maintain a balance therein equal to at least five percent of the outstanding obligations which are guaranteed by the fund and provision shall be made in the annual city budget therefor. The tax levy for payment into the guaranty fund in any one year shall not exceed the greater of (1) twelve percent of the outstanding obligations guaranteed by the fund, or (2) the total amount of delinquent assessments and interest accumulated on the delinquent assessments before the levy as of September 1st. (Ord. 609 § 2, 1987)

3.04.320 Local improvement guaranty fund—Investments authorized—Disposition of interest paid.

A.    The money held in the guaranty fund may be invested in any investments that are permitted for the investment of the city’s money, and the interest received from such investments and any surplus remaining in any local improvement district fund after payment of all bonds and warrants payable from such fund and guaranteed by the guaranty fund, shall be paid into the guaranty fund.

B.    Whenever any sum is paid out of the guaranty fund on account of the principal or interest on a local improvement bond or warrant, the city, as trustee of the guaranty fund, shall be subrogated to all the rights of the holder of the bond or warrant so paid and the proceeds thereof or of the underlying assessment shall become part of the guaranty fund. (Ord. 609 § 3, 1987)

3.04.330 Local improvement guaranty fund—Warrants.

Warrants drawing interest at a rate established by the issuing officer under the direction of the city council shall be issued against the guaranty fund to meet any liability accruing against it. The warrants so issued shall at no time exceed five percent of the outstanding obligations guaranteed by the guaranty fund. As among the several issues of bonds or warrants guaranteed by the guaranty fund, no preference shall exist, and defaulted bonds and warrants against local improvement district funds of the city shall be purchased out of the guaranty fund in the order of their presentation. 3.04.340 Local improvement guaranty fund—City liability limitations.

The city shall not be liable to any holder of any bond or warrant guaranteed by the guaranty fund for any loss to the guaranty fund occurring in the lawful operation thereof. (Ord. 609 § 5, 1987)

3.04.350 Local improvement guaranty fund—Purchases authorized.

So much of the money of the guaranty fund as is necessary for the purpose of protecting the guaranty fund may be used to purchase bonds or warrants guaranteed by the guaranty fund, or to purchase certificates of delinquency for general taxes on property subject to local improvement assessments which underlie the bonds or warrants guaranteed by the guaranty fund, or to purchase such property at tax foreclosures. The guaranty fund shall be subrogated to the rights of the city, and the city, acting on behalf of the guaranty fund, may foreclose the lien of general tax certificates of delinquency and purchase the property at the foreclosure sale for the account of the guaranty fund. Whenever the council shall so cause a lien of general tax certificates of delinquency to be foreclosed and the property to be so purchased at a foreclosure sale, the court costs and costs of publication and expenses for clerical work and/or other expenses incidental thereto shall be chargeable to and payable from the guaranty fund. After so acquiring title to real property, the city may lease or sell and convey the same at public or private sale for such price and on such terms as may be determined by the city council and all proceeds resulting from such sales shall belong to and be paid into the guaranty fund. 3.04.360 Local improvement guaranty fund—Transfer of excess moneys and investments.

If at any time money and investments (excluding bonds, warrants, certificates of delinquency or other assets of the guaranty fund acquired in the operation of the fund pursuant to Section 3.04.350 of this chapter) in the guaranty fund shall exceed the then required percentage to secure payment of outstanding obligations guaranteed by the fund, such excess may, by ordinance of the council, be transferred to the general fund of the city; provided, that the required percentage shall not be reduced by such transfer to an amount not less than ten percent of the net outstanding obligations guaranteed by such fund. 3.04.370 Law enforcement services enhancement fund—Established—Purpose.

A.    There shall be and is established a separate fund called the law enforcement services enhancement fund which shall be established by the city treasurer/finance director into which shall be deposited any and all sums of money received from either the municipal court of Battle Ground or Clark County district court as a result of the courts assessing a fine, fee or charge for emergency response by the Battle Ground police department for matters involving drivers influenced by drugs or alcohol.

B.    This fund is to be used for the enhancement of law enforcement services, including enforcement, training and education, equipment and staffing. (Ord. 02-009 § 14, 2002: Ord. 94-753 §§ 1, 2, 1994)

3.04.380 Handicapped parking drug reduction enhancement fund—Established—Purpose.

A.    There shall be and is established a separate fund called the handicapped parking drug reduction enhancement fund which shall be established by the city treasurer/finance director into which shall be deposited any and all sums of money received from either the municipal court of Battle Ground or Clark County district court as a result of the courts assessing a bail, or fine for drivers who have unlawfully parked in an area designated for parking by handicapped persons.

B.    This fund is to be used for the enhancement of law enforcement services as it relates to a drug reduction program. (Ord. 02-009 § 15, 2002: Ord. 94-754 §§ 1, 2, 1994)
