LODGING TAX ADVISORY COMMITTEE

2.64.010 Created—Membership—Appointment—Terms.

There is established a tax advisory committee of five members to serve without compensation and to be known as the Battle Ground lodging tax advisory committee, whose members shall be appointed by the mayor and confirmed by city council. Each tax advisory committee member shall serve for a term of three years. The respective terms of office shall be staggered to provide continuity for the committee. The number of members who are representatives of businesses required to collect tax under this chapter shall equal the number of members who are involved in activities authorized to be funded by revenue received under this chapter (two each). One member shall be an elected official of the municipality who shall serve as chair of the committee. The advisory committee may include one nonvoting member who is an elected official of Clark County. The appointing authority shall review the membership of the advisory committee annually and make changes as appropriate. The mayor may remove any member of the committee for any reason other than disagreement, with an official recommendation of the committee or its members, provided that the majority of the city council must confirm such removal. 2.64.020 Duties.

The board is entrusted with the responsibilities of advising and making recommendations concerning the collection and use of lodging taxes. The city shall submit any proposal that will impose a tax under Chapter 67.28 RCW, increase the rate of a tax imposed under this chapter, repeal an exemption from a tax imposed under this chapter, or change the use of revenue received under this chapter, to the lodging tax advisory committee for review and comment. The submission shall occur at least forty-five days before final action on or passage of the proposal by the municipality. The advisory committee shall submit comments on the proposal in a timely manner through generally applicable public comment procedures. The comments shall include an analysis of the extent to which the proposal will accommodate activities for tourists or increase tourism, and the extent to which the proposal will affect the long-term stability of the fund created under RCW 67.28.1815. Failure of the advisory committee to submit comments before final action on or passage of the proposal shall not prevent the municipality from acting on the proposal. A municipality is not required to submit an amended proposal to an advisory committee under this section. (Ord. 04-001 § 2, 2004)

2.64.030 Procedure.

The board shall convene meetings when necessary to meet the duties required under this chapter of the Battle Ground Municipal Code. Records of the committee meetings will be kept by a committee member who shall be appointed secretary and shall submit such record to the city clerk. A majority of the members of the committee shall constitute a quorum for the transaction of business and any action taken by a majority of those present shall be deemed action of the committee.
