Policy No. PR.01.91: Regulation of banner use at city facilities

1.0 PURPOSE

1.1 The purpose of this policy is to regulate Banners in a manner as to support and compliment the use of the Banner facilities as well as to promote the public health, safety and welfare.

3.0 DEFINITIONS:

3.1 Banner

The Port Angeles Parks & Recreation Department has established two (2) sites along east Front Street, and one (1) site on East First Street for display of Banners. A Banner is a 30' x 25" strip of canvas on which a sign may be painted, which is intended to convey information, attract attention to activities, services, places, subjects, people, public performances, or to convey a message.

4.0 PHILOSOPHY:

4.1 Banners are a direct imposition on every driver and passenger traveling west on Front Street, and east on First Street in Port Angeles. These Banners occupy public space on facilities, installed and maintained by the City of Port Angeles. The Port Angeles Parks, Recreation and Beautification commission has determined that those signs should be permitted only when they provide direct and positive benefits to the residents of Port Angeles and do separate community activities and City functions from "for profit" activities of private enterprises, political issues and the messages of religious organizations. The message presented and the appearance of the sign make a strong impression on residents and visitors viewing the signs.

5.0 POLICY:

5.1 This policy shall regulate all Banners under Parks jurisdiction and shall be in addition to other municipal regulations 5.2 All Banners to be displayed at Park Department facilities shall require authorization of the Parks and Recreation Director or his/her designee.

6.0 PROCEDURES:

6.1 Application -

Before any Banner is authorized, the following information must be provided to the Director of Parks & Recreation:

  • Sponsor of the activity to be advertised
  • A sketch of the proposed sign
  • Requested duration
  • Name, address, and phone number of the contact person

6.2 Payment -

Before any Banner is installed, the following must be completed:

  • Payment must be received within (3) weeks following the reservation. In order for the reservation to become final.
  • A written receipt shall be issued to the scheduled group/individual at time of payment.
  • Groups who use these facilities on a regular basis, or under other extenuating circumstances as determined by the Director, can make arrangements to be invoiced.

6.3 Allowable Displays -

The following are Banners permitted for display:

  • Advertisements or promotions of non-profit organizations
  • Advertisements or promotions of community activities and/or festivals
  • Activities sponsored by the City of Port Angeles
  • Athletic and special community events that are commercially sponsored, when proceeds are used for community service
  • Welcome messages, such as those for class reunions, conventions, and conferences, athletic tournament participation, fishing event participants, local winner of major event, etc.
  • Promotion of sales and money raising for youth organizations for their program support, non-profit and community service organizations when a major portion of the profit will be for community and youth projects.
  • Non-partisan and non-candidate voting information.

6.3 Non-Allowable Displays -

The following are examples of Banners that are not permitted for display:

  • Personal messages for family members
  • Promotion of a commercial enterprise "for profit" activity
  • Advertisements for clubs, churches or profit organizations promoting an event with an admission charge and when the profits will not be used for youth in the community or for a Port Angeles community service project.
  • Advertisements for religious organizations with a message not related to an allowed category
  • Messages of political parties or political groups that are not related to an allowed category
  • Advertisements of clubs or organizations for events which would be primarily for listed membership participation.

7 0 APPEAL PROCESS:

7.1 Requests for Banners that are determined to be non-allowable by the Director of Parks & Recreation may be appealed to the Parks, Recreation and Beautification Commission for final determination.

7.2 Written appeals must be provided and submitted to the Director at least ten (10) working days prior to the Park Board meeting at which time the item will be considered.

7.3 The Park Board will base all final decisions on the following criteria:

  • The proposed design of the sign
  • Whether or not the proposed banner is intended for advertising for a profit making corporation or venture.
  • Whether or not the proposed Banner protects and promotes general health, safety and welfare of the community.
  • Whether or not the proposed sign separates City functions and community activities from "for profit" activities of private enterprise, political issues and the message of religious organizations.

8.0 GENERAL:

8.1 Because the message presented and the sign appearance make a strong impression on residents and visitors viewing the signs, Banner design must be of at least "semi-professional" nature and must be aesthetically appealing.
