Project Title: GMA Update
The GRANTEE is responsible for the preparation of all contract deliverables set forth below. The process and product shall be substantially consistent with the GRANTEE'S grant application submitted to the Department for this round of funding and with the requirements of the Growth Management Act. Deliverables will be provided to the Department in electronic format wherever possible. At the Department's or the GRANTEE'S request, deliverables may be provided in paper format.
1. Project Description: The project will provide an update of the Cheney Comprehensive Plan, as required by GMA. The grant project consists of two parts. First, the project will provide for a revision of the Critical Areas section of the City's zoning ordinance to include Best Available Science practices. Also, the project will provide a revision of the Capital Facilities Element of the Cheney Comprehensive Plan, including essential public facilities.
a. Critical Areas Ordinance: The project will include a review of the existing "Conservation of Critical Areas" Chapter 21.70 of the Cheney Zoning Ordinance, in particular, Section 21.70.050 that pertains to wetlands. Since this chapter was written in 1996, certain subsections, as they apply to categories of wetlands, buffer requirements, mitigation requirements, and definitions of wetland habitats, have errors and inconsistencies in interpretation. These subsections need to be reviewed and amended using a "Best Available Science" analysis approach, particularly using as a reference the appropriate guidance documents available form the Department of Ecology and other sources included in "Citations of Best Available Science for Designating and Protecting Critical Areas, July 2001, Washington State Office of Community Development. In addition, there are currently no regulations or written procedures explaining how to implement the critical areas ordinance, including administrative responsibility, enforcement, and penalties. This work will be undertaken by a qualified wetland specialist.
b. Capital Facilities Element of Cheney Comprehensive Plan: The focus of this part of the project is to create an effective linkage between capital facilities and other key elements of the Comprehensive Plan. The project will also include the development of written procedures for the coordination of the City's functional capital plans (water plan, sewer plan, park plan, etc.) and the Comprehensive Plan. The project will also focus on developing an interagency process to site essential public facilities, an effort currently underway in Spokane County. An example would be the current effort of siting Less Restrictive Alternatives for Residential Treatment Facilities for Sex Offenders.
